2 | AMENDMENT NO. ______. Amend House Bill 5918, AS AMENDED, by | ||||||
3 | replacing everything after the enacting clause with the | ||||||
4 | following:

5 | "Section 5. The Good Samaritan Act is amended by adding | ||||||
6 | Section 71 as follows: | ||||||
7 | (745 ILCS 49/71 new) | ||||||
8 | Sec. 71. Exemption from civil liability in emergencies
| ||||||
9 | requiring building evacuations. Any person who in good faith | ||||||
10 | provides emergency care, without fee or compensation, to any | ||||||
11 | person at the scene of an emergency that necessitates the | ||||||
12 | evacuation of a building shall not, as a result of his or her | ||||||
13 | acts or omissions, except willful and wanton misconduct on the | ||||||
14 | part of the person in providing the emergency care, be liable | ||||||
15 | to a person to whom such emergency care is provided for civil | ||||||
16 | damages. This Section shall apply to causes of action accruing |

1 | on or after the effective date of this amendatory Act of the | ||||||
2 | 96th General Assembly.

3 | Section 99. Effective date. This Act takes effect upon | ||||||
4 | becoming law.".
