Amends the Medical Patient Rights Act. Expands the definition of "health care provider" to include nursing homes (rather than skilled nursing homes only). Permits a patient to recover damages in a civil action brought under the Act. Effective immediately.

| AN ACT concerning regulation.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Medical Patient Rights Act is amended by |
5 |
| changing Sections 2.03 and 4 as follows:
|

| Sec. 2.03.
"Health care provider" means any public or |
8 |
| private facility
that provides, on an inpatient or outpatient |
9 |
| basis, preventive, diagnostic,
therapeutic, convalescent, |
10 |
| rehabilitation, mental health or mental retardation
services, |
11 |
| including general or special hospitals, skilled nursing homes,
|
12 |
| extended care facilities, intermediate care facilities and |
13 |
| mental health centers.

| Sec. 4. Violations. Any physician or health care provider |

| that violates
a patient's rights as set forth in subparagraph |

| (b) of Section 3
is guilty of a petty offense and shall be |

| fined $500. Any insurance company
or health service corporation |

| that violates a patient's rights as set forth
in subparagraph |
21 |
| (c) of Section 3 is guilty of a petty offense and
shall be |
