SYNOPSIS AS INTRODUCED:
 
410 ILCS 50/2.03   from Ch. 111 1/2, par. 5402.03
410 ILCS 50/4   from Ch. 111 1/2, par. 5404

    Amends the Medical Patient Rights Act. Expands the definition of "health care provider" to include nursing homes (rather than skilled nursing homes only). Permits a patient to recover damages in a civil action brought under the Act. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Medical Patient Rights Act is amended by
5 changing Sections 2.03 and 4 as follows:
 
6     (410 ILCS 50/2.03)  (from Ch. 111 1/2, par. 5402.03)
7     Sec. 2.03. "Health care provider" means any public or
8 private facility that provides, on an inpatient or outpatient
9 basis, preventive, diagnostic, therapeutic, convalescent,
10 rehabilitation, mental health or mental retardation services,
11 including general or special hospitals, skilled nursing homes,
12 extended care facilities, intermediate care facilities and
13 mental health centers.

16     Sec. 4. Violations. Any physician or health care provider
17 that violates a patient's rights as set forth in subparagraph
18 (b) of Section 3 is guilty of a petty offense and shall be
19 fined $500. Any insurance company or health service corporation
20 that violates a patient's rights as set forth in subparagraph
21 (c) of Section 3 is guilty of a petty offense and shall be
22 fined $1,000. Any physician, health care provider, health

1 services corporation or insurance company that violates a
2 patient's rights as set forth in subsection (d) of Section 3 is
3 guilty of a petty offense and shall be fined $1,000. A patient
4 may also recover damages in a civil action for any violation of
5 this Act.

7     Section 99. Effective date. This Act takes effect upon
