Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that the Department of Healthcare and Family Services shall establish the Long-Term Care Disproportionate Share Adjustment Program to aid long-term care facilities licensed by the Department of Public Health, under the Nursing Home Care Act, as skilled care or intermediate care facilities that serve a preponderance of Medicaid residents. Further provides that long-term care facilities determined by the Department to qualify for the program shall receive an add-on adjustment to their nursing component rate, which shall be established by rule no later than December 31, 2010 and adjusted annually thereafter. Effective immediately.

| AN ACT concerning public aid.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Public Aid Code is amended by |
5 |
| adding Section 5-5.8a-1 as follows: |

| Sec. 5-5.8a-1. Long-term care disproportionate share |
8 |
| adjustment. The Department shall establish a payment |
9 |
| adjustment program to aid long-term care facilities licensed by |
10 |
| the Department of Public Health, under the Nursing Home Care |
11 |
| Act, as skilled care or intermediate care facilities that serve |
12 |
| a preponderance of Medicaid residents. The program shall be |
13 |
| referred to as the Long-Term Care Disproportionate Share |
14 |
| Adjustment Program. Long-term care facilities determined by |
15 |
| the Department to qualify for the program shall receive an |
16 |
| add-on adjustment to their nursing component rate, which shall |
17 |
| be established by rule no later than December 31, 2010 and |
18 |
| adjusted annually thereafter.

| Section 99. Effective date. This Act takes effect upon |
20 |
| becoming law.
