AMENDMENT TO HOUSE BILL 6034

    AMENDMENT NO. ______. Amend House Bill 6034 by replacing

everything after the enacting clause with the following:

    "Section 5. The Department of Public Health Powers and 
5
Duties Law of the
Civil Administrative Code of Illinois is 
6
amended  by adding Section 2310-655 as follows:

    (20 ILCS 2310/2310-655 new)
8
    Sec. 2310-655. Technical assistance on playgrounds. The 
9
Department of Public Health shall develop a technical 
10
assistance program on public playground issues in the play 
11
areas of parks, schools, and recreational developments. The 
12
program may be presented annually and may be available through 
13
the Department's website. The Department may inform public 
14
health entities within this State of the program. A 
15
representative from each affected entity in the State may 
16
participate in the program.

    The Department shall  develop technical assistance 
2
materials based on guidelines or standards such as the U.S. 
3
Consumer Product Safety Commission's guidelines, the U.S. 
4
Access Board final guidelines, or the standards of the American 
5
Society for Testing and Materials by June 30, 2011. The  
6
technical assistance materials may include a recommended 
7
timeframe by which entities in this State that own or manage 
8
playgrounds  may meet the guidelines of the rules.
9
    Nothing in this Section shall be construed as imposing any 
10
mandate concerning equipment in restaurants or dwellings.".
