1 | AMENDMENT TO HOUSE BILL 6083

2 | AMENDMENT NO. ______. Amend House Bill 6083 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 1. Short title. This Act may be cited as the Laser | ||||||
5 | Speed Detection Device Act. | ||||||
6 | Section 5. Admissibility of evidence; laser speed | ||||||
7 | detection device. Evidence of speed based on a speed detection | ||||||
8 | device using the speed timing principle of laser which is of a | ||||||
9 | model that has been approved by the Department of State Police | ||||||
10 | shall be considered scientifically acceptable and reliable as a | ||||||
11 | speed detection device and shall be admissible for all purposes | ||||||
12 | in any court or administrative proceeding in this State, | ||||||
13 | subject to the rules of evidence that are applicable to that | ||||||
14 | court or proceeding, including rules requiring the | ||||||
15 | establishment of an adequate foundation for the evidence. A | ||||||
16 | certified copy of the Department of State Police list of |

1 | approved models of such laser devices shall be | ||||||
2 | self-authenticating and shall be admissible for all purposes in | ||||||
3 | any court or administrative proceeding in this State. The | ||||||
4 | technology used by any such approved device shall not be | ||||||
5 | considered new or novel for the purposes of detecting speed of | ||||||
6 | a vehicle.

7 | Section 999. Effective date. This Act takes effect upon | ||||||
8 | becoming law.".
