Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that whenever a person sells to a consumer merchandise consisting of a wireless telecommunication device that is not subject to a contract for wireless telecommunication service, the seller must obtain the consumer's name and address. Requires the seller to maintain that record for one year. Makes a seller's failure to do so an unlawful practice under the Act.

| AN ACT concerning business.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Consumer Fraud and Deceptive Business |
5 |
| Practices Act is amended by adding Section 2III as follows: |

| (815 ILCS 505/2III new) |
7 |
| Sec. 2III. Sale of wireless telecommunication device not |
8 |
| subject to contract for wireless telecommunication service. |
9 |
| Whenever a person sells to a consumer merchandise consisting of |
10 |
| a wireless telecommunication device that is not subject to a |
11 |
| contract for wireless telecommunication service, the seller |
12 |
| must obtain the consumer's name and address. The seller must |
13 |
| maintain that record for one year. A seller's failure to comply |
14 |
| with this Section is an unlawful practice within the meaning of |
15 |
| this Act.
