| AN ACT concerning State government.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Department of Commerce and Economic |

| Opportunity Law of the
Civil Administrative Code of Illinois is |
| 6 |
| amended by adding Section 605-1005 as follows:
|

| 8 |
| Sec. 605-1005. Technology transfer incentives. The |
| 9 |
| Department may, subject to appropriation, create financial |
| 10 |
| incentive and grant programs to encourage private companies to |
| 11 |
| share their new energy technologies with public institutions of |
| 12 |
| higher education, public utilities, electric cooperatives, |
| 13 |
| State agencies, and federal agencies. For the purposes of this |
| 14 |
| Section, "public institutions of higher education" has the same |
| 15 |
| meaning as under Section 1 of the Board of Higher Education |
| 16 |
| Act; "public utility" has the same meaning as under Section |
| 17 |
| 3-105 of the Public Utilities Act; "electric cooperative" has |
| 18 |
| the same meaning as under Section 3-119 of the Public Utilities |
| 19 |
| Act; "State agency" has the same meaning as under Section 1-10 |
| 20 |
| of the Illinois Administrative Procedure Act; and "federal |
| 21 |
| agency" has the same meaning ascribed to the term "agency" |
| 22 |
| under Section 551 of the federal Administrative Procedure Act.
