SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/5.755 new
210 ILCS 50/3.225a new

    Amends the State Finance Act and the Emergency Medical Services (EMS) Systems Act. Creates the Coroner Trauma Fund, a special fund in the State Treasury. Provides that the Department of Public Health shall distribute 97.5% of the moneys deposited into the Coroner Trauma Fund to Illinois coroners and medical examiners; that no money may be distributed to a coroner or medical examiner located outside of the State; and that the distribution to individual coroners and medical examiners shall be based on the total number of trauma deaths where the manner of death is certified by the coroner, medical examiner, or coroner's inquest jury to be ACCIDENT, SUICIDE, HOMICIDE, or UNDETERMINED. Contains provisions concerning payment calculations under the fund, reporting requirements for county coroners or medical examiners, and distribution dates. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Finance Act is amended by adding
5 Section 5.755 as follows:
 
6     (30 ILCS 105/5.755 new)
7     Sec. 5.755. Coroner Trauma Fund.
 
8     Section 10. The Emergency Medical Services (EMS) Systems
9 Act is amended by adding Section 3.225a as follows:
 
10     (210 ILCS 50/3.225a new)
11     Sec. 3.225a. Coroner Trauma Fund.
12     (a) The Department shall distribute 97.5% of the moneys
13 deposited into the Coroner Trauma Fund, a special fund in the
14 State Treasury, to Illinois coroners and medical examiners. No
15 money may be distributed to a coroner or medical examiner
16 located outside of the State. The distribution to individual
17 coroners and medical examiners shall be based on the total
18 number of trauma deaths where the manner of death is certified
19 by the coroner, medical examiner, or coroner's inquest jury to
20 be ACCIDENT, SUICIDE, HOMICIDE, or UNDETERMINED. Traumatic
21 deaths shall include all deaths listed under Section

1 515.2050(c)(2) of Title 77 of the Illinois Administrative Code
2 (Trauma Center Uniform Reporting Requirements).
3     (b) Moneys in the fund shall be allocated proportionally to
4 each coroner and medical examiner based on the total number of
5 trauma deaths certified by the county coroner or medical
6 examiner and the moneys shall be collected from fees matching
7 all fees collected pursuant to the Trauma Center Fund as
8 established in Section 3.225 of this Act.
9     (c) At the beginning of each State fiscal year, the
10 Department shall calculate a per trauma case allocation for
11 each coroner and medical examiner, which shall be used to
12 determine each coroner and medical examiner's share of funds
13 collected during the previous State fiscal year.
14     (d) To determine the percent of the Coroner Trauma Fund to
15 be received by each coroner or medical examiner, the Department
16 shall divide the total moneys deposited into the Coroner Trauma
17 Fund, after deducting administrative fees not exceeding 2.5% of
18 total moneys collected, by the total number of traumatic deaths
19 in the entire State during the preceding State fiscal year.
20     (e) Each county coroner or medical examiner shall provide
21 to the Department, by July 15 of each year, a report of all
22 traumatic deaths which occurred in the prior State fiscal year.
23 The report shall include all of the following:
24         (1) Decedent's full name.
25         (2) Decedent's date of birth.
26         (3) Decedent's social security number (if available).

1         (4) Decedent's date of death.
2         (5) Decedent's cause of death.
3         (6) Decedent's manner of death.
4     (f) Data collected from individual coroners and medical
5 examiners shall be cross-referenced with death certificates
6 registered with the Office of Vital Records to confirm
7 accuracy.
8     (g) The Department shall distribute moneys from the Coroner
9 Trauma Fund within 90 days after July 1 of each year.
 
10     Section 99. Effective date. This Act takes effect upon
11 becoming law.
