AMENDMENT TO HOUSE BILL 6439

2     AMENDMENT NO. ______. Amend House Bill 6439 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Findings. The General Assembly makes the
5 following findings:
6         (1) The quality of life of a growing number of Illinois
7     families has been impacted by a significant increase in bed
8     bug (Cimex lectularius) infestations.
9         (2) A joint EPA/CDC statement recognizes bed bugs as a
10     pest of public health importance.
11         (3) Bed bug infestations are ubiquitous, uniquely
12     difficult to abate, and pose a challenge to the rights and
13     responsibilities of those affected by such infestations.
14         (4) There is a substantial lack of public knowledge
15     about bed bug treatment and prevention, necessitating the
16     need for targeted consumer education and communication.
17         (5) In April of 2009, the United States Environmental

1     Protection Agency held its first National Bed Bug Summit to
2     solicit recommendations on dealing with the growing public
3     nuisance of bed bugs; among the major recommendations
4     emanating from the summit was the importance of legislative
5     support and better education about bed bugs for governments
6     and elected officials.
7         (6) It is in the public interest to create a task force
8     to study the increase in bed bug infestations and make
9     specific recommendations for public policy measures to
10     combat this growing public nuisance.
 
11     Section 5. The Safe and Hygienic Bed Act is amended by
12 adding Section 50 as follows:
 
13     (410 ILCS 68/50 new)
14     Sec. 50. Illinois Bed Bug Task Force. The Illinois Bed Bug
15 Task Force is hereby created within the Department. The
16 Department shall provide staff and administrative support to
17 the Task Force.
18     The Task Force shall make recommendations on the prevention
19 and treatment of bed bug infestations in private dwellings,
20 public accommodations, and institutions; State standards for
21 the disposal of bed bug-infested items; the training,
22 education, and certification of pest management professionals;
23 and the development of public education materials on bed bug
24 prevention and treatment, including specific information on

1 the rights and responsibilities of tenants, landlords, and
2 property owners.
3     The Task Force shall consist of 10 members appointed by the
4 Governor, one of which shall have advanced experience in
5 entomology and at least one of which shall come from each of
6 the following fields:
7         (1) a representative of the pest management industry;
8         (2) a representative of an organization involved in
9     higher education issues;
10         (3) a representative of a nonprofit organization,
11     particularly one involved with tenant advocacy issues; and
12         (4) a representative of apartment associations.
13     In addition to these members, the following officials or
14 their designees may serve as ex officio members of the Task
15 Force: the Director of Public Health; the Director of
16 Agriculture; the Illinois Attorney General; and the Executive
17 Director of the Illinois Housing Development Authority.
18     The Task Force shall report its findings to the General
19 Assembly on or before January 1, 2011.
 
20     Section 99. Effective date. This Act takes effect upon
21 becoming law.".
