AMENDMENT TO HOUSE BILL 6460 




2    AMENDMENT NO. ______. Amend House Bill 6460, AS AMENDED, 
3with reference to page and line numbers of Senate Amendment No. 
41, on page 6, by replacing lines 9 through 16 with the 
5following:


6"period, commits 3 or more
separate offenses  constituting any 
7combination of the following:
8        (1) an offense under this Article; , 
9        (2) a felony offense in violation of Section 16A-3 or 
10    paragraph (4) or (5) of subsection (a) of Section 16-1 of 
11    this Code for the purpose of reselling or otherwise 
12    re-entering the merchandise in commerce, including 
13    conveying the merchandise to a merchant in exchange for 
14    anything of value; or
15        (3) , if involving a financial institution,
any other 
16    felony offense offenses established under this Code."; and
 

17by replacing lines 22 through 24 on page 6 and lines 1 through

19 on page 7  with the following:


2"continuing
financial crimes enterprise when the person:


3        (1) with the intent to commit an offense under this 
4    Article, agrees with another person to the commission of 
5    any combination of the following  offenses on 3 or
more 
6    separate occasions within an 18 month period:
7            (A) an offense under this Article;
8            (B) a felony offenses in violation of Section 16A-3 
9        or paragraph (4) or (5) of subsection (a) of Section 
10        16-1 of this Code for the purpose of reselling or 
11        otherwise re-entering the merchandise in commerce, 
12        including conveying the merchandise to a merchant in 
13        exchange for anything of value; or
14            (C) , if
involving a financial institution, any 
15        other felony offense established under
this Code, 
16        agrees with another person to the commission of that 
17        offense on 3 or
more separate occasions within an 18 
18        month period, and"; and
 

19on page 7, line 22 by inserting after "of" the following:


20"subdivision (2) of Section 16H-50 or subdivision (a)(1)(B) of 
21Section 16H-55 of".
