    Amends the Illinois Literacy Act, the State Finance Act, and the School Code. Provides that the authority of the Secretary of State to award grants that develop, expand, or support adult literacy programs through community programs administered by education agencies, libraries, or volunteer or community-based organizations is transferred to the State Board of Education on January 1, 2011. Provides that the awarding of grants must be based on documented literacy rate needs in communities. Provides that moneys in the Secretary of State Special Services Fund and the Live and Learn Fund may be transferred to the Adult Literacy Grant Fund (created as a special fund in the State treasury) for use by the State Board of Education for adult literacy grants. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Literacy Act is amended by changing
5Section 15 as follows:
 
6    (15 ILCS 322/15)
7    Sec. 15. Grants.
8    (a) Until January 1, 2011, the The Secretary of State, in
9consultation with the Literacy Advisory Board created by
10Section 7.2 of the State Library Act, is authorized to award
11grants that develop, expand, or support adult literacy programs
12in Illinois through community programs administered by
13education agencies, libraries, volunteer or community-based
14organizations, or a coalition of any of those groups.
15    With regard to these grants, on January 1, 2011, all
16powers, duties, assets, liabilities, contracts, property,
17records, pending business, and unexpended funds of the
18Secretary of State are transferred to the State Board of
19Education. With regard to the grants, beginning on January 1,
202011, references in statutes, rules, forms, and other documents
21to the Secretary of State shall, in appropriate contexts, be
22deemed to refer to State Board of Education. All rules,
23standards, and procedures adopted by the Secretary of State

1with regard to the grants that are in effect on January 1, 2011
2shall continue in effect as the rules, standards, and
3procedures of the State Board of Education until they are
4amended or repealed by the State Board of Education.
5    (b) The Secretary of State, in consultation with the
6Literacy Advisory Board created by Section 7.2 of the State
7Library Act, is authorized to award grants for workplace
8programs to public or private employers or entities acting on
9behalf of a coalition of employers to improve the basic skills
10of current and prospective employees. Current and prospective
11employees' lack of basic skills may impede hiring, effective
12job performance, or eligibility for advancement. Public funds
13awarded under this grant program must be matched by the
14business with funds at least equal to the amount of public
15funds awarded.
16    (c) The Secretary of State is authorized to make family
17literacy grants that will assist in breaking the
18intergenerational cycle of illiteracy. The grants must involve
19an adult literacy component and an entity working with children
20at risk of school failure. Programs will focus on parents or
21guardians and children involved in reciprocal learning and
22teaching. In addition to other grants authorized in this
23subsection, the Secretary of State may make family literacy
24grants, upon his or her approval of application from entities,
25for innovative programming in the area of parent and child
26learning activities. The Secretary of State shall establish

1criteria for awarding the grants by rule. The Secretary of
2State may expend appropriations statewide for direct purchases
3of equipment and services that support families learning
4together.

6    Section 10. The State Finance Act is amended by adding
7Section 5.755 and by changing Sections 6z-34 and 6z-35 as
8follows:

10    Sec. 5.755. The Adult Literacy Grant Fund.

12    Sec. 6z-34. Secretary of State Special Services Fund. There
13is created in the State Treasury a special fund to be known as
14the Secretary of State Special Services Fund. Moneys deposited
15into the Fund may, subject to appropriation, be used by the
16Secretary of State for any or all of the following purposes:
17        (1) For general automation efforts within operations
18    of the Office of Secretary of State.
19        (2) For technology applications in any form that will
20    enhance the operational capabilities of the Office of
21    Secretary of State.
22        (3) To provide funds for any type of library grants
23    authorized and administered by the Secretary of State as

1    State Librarian.
2    These funds are in addition to any other funds otherwise
3authorized to the Office of Secretary of State for like or
4similar purposes.
5    On August 15, 1997, all fiscal year 1997 receipts that
6exceed the amount of $15,000,000 shall be transferred from this
7Fund to the Statistical Services Revolving Fund; on August 15,
81998 and each year thereafter through 2000, all receipts from
9the fiscal year ending on the previous June 30th that exceed
10the amount of $17,000,000 shall be transferred from this Fund
11to the Statistical Services Revolving Fund; on August 15, 2001
12and each year thereafter through 2002, all receipts from the
13fiscal year ending on the previous June 30th that exceed the
14amount of $19,000,000 shall be transferred from this Fund to
15the Statistical Services Revolving Fund; and on August 15, 2003
16and each year thereafter, all receipts from the fiscal year
17ending on the previous June 30th that exceed the amount of
18$33,000,000 shall be transferred from this Fund to the
19Statistical Services Revolving Fund.
20    Beginning with fiscal year 2011, moneys in the Secretary of
21State Special Services Fund may be transferred to the Adult
22Literacy Grant Fund for use by the State Board of Education for
23adult literacy grants under Section 2-3.153 of the School Code.

1    Sec. 6z-35. There is hereby created in the State Treasury a
2special fund to be known as the Live and Learn Fund. The
3Comptroller and the Treasurer shall transfer $1,742,000 from
4the General Revenue Fund into the Live and Learn Fund each
5month. The first transfer shall be made 60 days after the
6effective date of this amendatory Act of 1993, with subsequent
7transfers occurring on the first of each month. Moneys
8deposited into the Fund may, subject to appropriation, be used
9by the Secretary of State for any or all of the following
10purposes:
11        (a) An organ donation awareness or education program.
12        (b) To provide additional funds for all types of
13    library grants as authorized and administered by the
14    Secretary of State as State Librarian.
15    Beginning with fiscal year 2011, moneys in the Live and
16Learn Fund may be transferred to the Adult Literacy Grant Fund
17for use by the State Board of Education for adult literacy
18grants under Section 2-3.153 of the School Code.

1Fund, the State Board of Education is authorized to award

6Board of Education shall award these grants based on documented
7literacy rate needs in communities.
8    (b) The Adult Literacy Grant Fund is created as a special
9fund in the State treasury. All money in the Adult Literacy
10Grant Fund shall be used, subject to appropriation, by the
11State Board of Education for grants under this Section.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.
