2 | WHEREAS, On January 1, 2009, Public Act 95-773, known as | ||||||
3 | the Cindy Bischof Law, took effect; and
| ||||||
4 | WHEREAS, The Law requires that when a person is charged | ||||||
5 | with a violation of an order
of protection,
the court shall | ||||||
6 | order the respondent to undergo a risk
assessment and based on | ||||||
7 | the results of the risk assessment and the other
circumstances | ||||||
8 | of the violation, it permits the court to order that the
| ||||||
9 | person, as a condition of bail, be placed under electronic
| ||||||
10 | surveillance and it permits the court to order an offender who | ||||||
11 | is sentenced to
probation or conditional discharge for a | ||||||
12 | violation of an order
of protection to be placed under | ||||||
13 | electronic surveillance; and the Law requires that, as a | ||||||
14 | condition of parole or mandatory supervised release, a person | ||||||
15 | convicted of a violation of an order
of protection must be | ||||||
16 | placed under electronic surveillance; and
| ||||||
17 | WHEREAS, The Law requires the supervising authority to use | ||||||
18 | the best available global
positioning technology to track | ||||||
19 | domestic violence offenders; and
| ||||||
20 | WHEREAS, The General Assembly finds that a Task Force to | ||||||
21 | facilitate the implementation of the Cindy Bischof Law is | ||||||
22 | necessary; therefore, be it

1 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE | ||||||
2 | NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE | ||||||
3 | SENATE CONCURRING HEREIN, that the Cindy Bischof Law | ||||||
4 | Implementation Task Force is created within the Illinois | ||||||
5 | Department of Corrections; and be it further
| ||||||
6 | RESOLVED, That the Task Force shall consist of 22 members
| ||||||
7 | appointed as follows: | ||||||
8 | (1) 2 members appointed by the President of the Senate | ||||||
9 | of which one member shall be a Senator and one shall be a | ||||||
10 | member of the public;
| ||||||
11 | (2) 2 members appointed by the Minority Leader of the | ||||||
12 | Senate of which one member shall be a Senator and one shall | ||||||
13 | be a member of the public; | ||||||
14 | (3) 2 members appointed by the Speaker of the House of | ||||||
15 | Representatives of which one member shall be a | ||||||
16 | Representative and one shall be a member of the public; | ||||||
17 | (4) 2 members appointed by the Minority Leader of the | ||||||
18 | House of Representatives of which one member shall be a | ||||||
19 | Representative and one shall be a member of the public; | ||||||
20 | (5) one member representing the Illinois Attorney | ||||||
21 | General appointed by the Attorney General; | ||||||
22 | (6) one member representing the Administrative Office | ||||||
23 | of the Illinois Courts appointed by the Director of the | ||||||
24 | Administrative Office of the Illinois Courts; |

1 | (7) one member representing the Office of the Governor | ||||||
2 | appointed by the Governor; | ||||||
3 | (8) one member representing the Illinois Family | ||||||
4 | Violence Coordinating Council appointed by that Council; | ||||||
5 | (9) one member representing the Illinois Department of | ||||||
6 | Human Services, Bureau of Domestic & Sexual Violence | ||||||
7 | Prevention appointed by the Secretary of Human Services; | ||||||
8 | (10) one member representing the Illinois Department | ||||||
9 | of Corrections-Parole Division appointed by the Director | ||||||
10 | of Corrections; | ||||||
11 | (11) one member representing the Illinois State's | ||||||
12 | Attorneys Association appointed by that Association; | ||||||
13 | (12) one member representing the Illinois Association | ||||||
14 | of Chiefs of Police appointed by that Association; | ||||||
15 | (13) one member representing the Illinois Sheriffs' | ||||||
16 | Association appointed by that Association; | ||||||
17 | (14) one member representing the Chicago Metropolitan | ||||||
18 | Battered Women's Network appointed by that Network; | ||||||
19 | (15) one member representing the Illinois Coalition | ||||||
20 | Against Domestic Violence appointed by that Coalition; | ||||||
21 | (16) one member representing the Office of the Cook | ||||||
22 | County State's Attorney appointed by the Cook County | ||||||
23 | State's Attorney; | ||||||
24 | (17) one member representing the Illinois Probation | ||||||
25 | and Court Services Departments appointed by the Director of | ||||||
26 | the Administrative Office of the Illinois Courts; and |

1 | (18) one member representing the Cook County Adult | ||||||
2 | Probation Services Department appointed by the chief | ||||||
3 | probation officer of Cook County; and be it further | ||||||
4 | RESOLVED, That the Task Force shall choose its chairperson | ||||||
5 | and such other officers as it deems necessary; and be it | ||||||
6 | further | ||||||
7 | RESOLVED, That the Task Force shall facilitate the | ||||||
8 | implementation of the Cindy Bischof Law and study the progress | ||||||
9 | of implementation of the Cindy Bischof Law; and be it further | ||||||
10 | RESOLVED, That the members of the Task Force shall receive | ||||||
11 | no compensation as members of the Task Force but may be | ||||||
12 | reimbursed for actual expenses incurred by the members in | ||||||
13 | performance of their duties as members of the Task Force from | ||||||
14 | appropriations made for such purpose; and be it further | ||||||
15 | RESOLVED, That the Task Force shall make its | ||||||
16 | recommendations on the progress of implementation of the Cindy | ||||||
17 | Bischof Law and shall submit a report of its findings to the | ||||||
18 | Governor and the General Assembly by September 1, 2009 and | ||||||
19 | shall make quarterly reports to the Governor and the General | ||||||
20 | Assembly thereafter.
