HOUSE JOINT RESOLUTION

    WHEREAS, The Chicago Park District has filed applications 
3
with the Illinois Department of Natural Resources, requesting 
4
permits to install harbor facilities at Chicago Gateway Harbor  
5
and  the 31st Street Harbor  both in Lake Michigan in the City of 
6
Chicago to accommodate the ever-increasing boating public in 
7
the Chicago and northeastern Illinois areas; and


 
8
    WHEREAS, Section 18 of the Rivers, Lakes, and Streams Act 
9
provides that it is unlawful to commence the building of a 
10
harbor or mooring facility without (i) receiving a permit for 
11
the building of those facilities from the Department of Natural 
12
Resources, (ii) having the building of those facilities 
13
authorized by the General Assembly and approved by the 
14
Governor, and (iii) establishing that the building of those 
15
facilities shall be in aid of and not an interference with the 
16
public interest or navigation; and

 
17
    WHEREAS, The Department of Natural Resources, in 
18
fulfilling its statutory responsibilities, finds that the 
19
proposed construction programs requested by the Chicago Park 
20
District will be in aid of and not an interference with the 
21
public interest or navigation, as that phrase is defined in 
22
Section 18 of the Rivers, Lakes, and Streams Act, and the 
23
Department offers no objection to the building of such

facilities; therefore, be it

    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE 
3
NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE 
4
SENATE CONCURRING HEREIN, that the Chicago Park District is 
5
hereby authorized to construct a floating marina, to be 
6
anchored to the bed of Lake Michigan, for the purpose of 
7
accommodating the mooring of 270 watercraft at the Chicago 
8
Gateway Harbor in accordance with the terms and conditions of 
9
the permits issued by the Department of Natural Resources under 
10
the provisions of the Rivers, Lakes, and Streams Act; and be it 
11
further

    RESOLVED, That the Chicago Park District is hereby 
13
authorized to construct a floating marina, to be anchored to 
14
the bed of Lake Michigan, for the purpose of accommodating the 
15
mooring of 850 watercraft at the 31st Street Harbor in 
16
accordance with the terms and conditions of the permits issued 
17
by the Department of Natural Resources under the provisions of 
18
the Rivers, Lakes, and Streams Act; and be it further
 
19
    RESOLVED, That the jurisdiction and control of the 
20
Department of Natural Resources over the bed of Lake Michigan 
21
under the Rivers, Lakes, and Streams Act shall in no way be 
22
diminished or limited by the authorizations and approvals 
23
granted herein and that the title to the bed of Lake Michigan

under the floating marinas authorized to be constructed shall 
2
remain in the State of Illinois and no improvements, other than 
3
those herein authorized and approved, shall be made without the 
4
further authorization and approval of the Department of Natural 
5
Resources under the provisions of the Rivers, Lakes, and 
6
Streams Act; and be it further
 
7
    RESOLVED, That the approval granted by this resolution with 
8
respect to a project is  rescinded if the approval of the 
9
Governor has not been received prior to the commencement of any 
10
work in connection with the construction of that project, and 
11
this approval does not apply to any work that is not in 
12
conformance with the permit issued by the Department of Natural 
13
Resources; and be it further
 
14
    RESOLVED, That a suitable copy of the resolution be 
15
immediately delivered to the Department of Natural Resources 
16
for filing with papers, documents, or other material, 
17
information, and data relating to the application for and 
18
processing of the permit for such work.
