HOUSE RESOLUTION

 
2     WHEREAS, The Department of Healthcare and Family Services
3 ("Department") administers the medical assistance ("Medicaid")
4 program under the Illinois Public Aid Code; and
 
5     WHEREAS, The Medicaid program provides coverage of nursing
6 home and other healthcare expenses for low-income persons; and
 
7     WHEREAS, Under the Illinois Public Aid Code, the Department
8 has the authority, in certain circumstances, to file claims
9 against the estates of deceased Medicaid recipients for amounts
10 expended on a recipient's behalf under the Medicaid program;
11 and
 
12     WHEREAS, If the deceased recipient was a nursing home
13 resident for a substantial period of time, a claim may amount
14 to many thousands of dollars, which can be quite a shock to the
15 recipient's heirs, executor, and/or administrator; and
 
16     WHEREAS, Because of the passage of time, there may be no
17 way to verify the correctness of some items comprising the
18 claim and the executor or administrator may have legitimate
19 concerns about his or her liability for approving such items;
20 therefore, be it

1     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
2 NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
3 the Department of Healthcare and Family Services examine the
4 methods by which a recipient, or his or her designee, while
5 still living, can be provided with timely notice of each item
6 of goods or services provided to the recipient under the
7 medical assistance program, including in the notice at least
8 the following: (i) a description of the item; (ii) the date the
9 item was provided; (iii) the name and address of the vendor
10 providing the item; and (iv) the cost of the item; and be it
11 further
 
12     RESOLVED, That the Department of Healthcare and Family
13 Services report its findings and recommendations to the House
14 of Representatives; and be it further
 
15     RESOLVED, That copies of this resolution be delivered to
16 the Governor and the Director of Healthcare and Family
17 Services.
