| 1 | AN ACT concerning finance.
| ||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
| 3 | represented in the General Assembly:
| ||||||||||||||||||||||||
| 4 | Section 5. The Illinois Procurement Code is amended by | ||||||||||||||||||||||||
| 5 | changing Section 20-80 as follows:
| ||||||||||||||||||||||||
| 6 | (30 ILCS 500/20-80)
| ||||||||||||||||||||||||
| 7 | Sec. 20-80. Contract files.
| ||||||||||||||||||||||||
| 8 | (a) Written determinations. All written determinations
| ||||||||||||||||||||||||
| 9 | required under this Article shall
be placed in the contract | ||||||||||||||||||||||||
| 10 | file maintained by the chief procurement officer.
| ||||||||||||||||||||||||
| 11 | (b) Filing with Comptroller. Whenever a grant, defined | ||||||||||||||||||||||||
| 12 | pursuant to
accounting standards established by the | ||||||||||||||||||||||||
| 13 | Comptroller, or a contract
liability,
except for:
(1) contracts | ||||||||||||||||||||||||
| 14 | paid
from personal services, or
(2) contracts between the State | ||||||||||||||||||||||||
| 15 | and its
employees to defer
compensation in accordance with | ||||||||||||||||||||||||
| 16 | Article 24 of the Illinois Pension Code,
exceeding $10,000 is | ||||||||||||||||||||||||
| 17 | incurred by any
State agency, a copy of the contract, purchase | ||||||||||||||||||||||||
| 18 | order, grant, or
lease shall be filed with the
Comptroller | ||||||||||||||||||||||||
| 19 | within 15 days thereafter. Any cancellation or
modification to | ||||||||||||||||||||||||
| 20 | any such contract
liability shall be filed with the Comptroller | ||||||||||||||||||||||||
| 21 | within 15 days of
its execution. If the Comptroller on his or | ||||||||||||||||||||||||
| 22 | her official website announces the State's awarding of a | ||||||||||||||||||||||||
| 23 | contract, the announcement must include at least as much | ||||||||||||||||||||||||
| |||||||
| |||||||
| 1 | information about the contract as is required to be included in | ||||||
| 2 | the notice of a contract award in the Procurement Bulletin | ||||||
| 3 | under subsection (b) of Section 15-25.
| ||||||
| 4 | (c) Late filing affidavit. When a contract, purchase order, | ||||||
| 5 | grant,
or lease required to be
filed by this Section has not | ||||||
| 6 | been filed within 30 days of
execution, the Comptroller shall | ||||||
| 7 | refuse
to issue a warrant for payment thereunder until the | ||||||
| 8 | agency files
with the Comptroller the
contract, purchase order, | ||||||
| 9 | grant, or lease and an affidavit, signed by the
chief executive | ||||||
| 10 | officer of the
agency or his or her designee, setting forth an | ||||||
| 11 | explanation of why
the contract liability was not
filed within | ||||||
| 12 | 30 days of execution. A copy of this affidavit shall
be filed | ||||||
| 13 | with the Auditor
General.
| ||||||
| 14 | (d) Professional and artistic services contracts. No
| ||||||
| 15 | voucher shall be submitted to the
Comptroller for a warrant to | ||||||
| 16 | be drawn for the payment of money
from the State treasury or | ||||||
| 17 | from
other funds held by the State Treasurer on account of any | ||||||
| 18 | contract
for services involving
professional or artistic | ||||||
| 19 | skills involving an expenditure of more
than $5,000 for the | ||||||
| 20 | same type of
service at the same location during any fiscal | ||||||
| 21 | year unless the
contract is reduced to writing
before the | ||||||
| 22 | services are performed and filed with the Comptroller.
When a | ||||||
| 23 | contract for
professional or artistic skills in excess of | ||||||
| 24 | $5,000 was not
reduced to writing before the services
were | ||||||
| 25 | performed, the Comptroller shall refuse to issue a warrant
for | ||||||
| 26 | payment for the services
until the State agency files with the | ||||||
| |||||||
| |||||||
| 1 | Comptroller:
| ||||||
| 2 | (1) a written
contract covering the services, and
| ||||||
| 3 | (2) an affidavit, signed by the chief executive officer | ||||||
| 4 | of the
State agency or his or her designee,
stating that | ||||||
| 5 | the services for which payment is being made were
agreed to | ||||||
| 6 | before commencement
of the services and setting forth an | ||||||
| 7 | explanation of why the
contract was not reduced to writing
| ||||||
| 8 | before the services commenced.
| ||||||
| 9 | A copy of this affidavit shall be
filed with the Auditor | ||||||
| 10 | General.
The Comptroller shall maintain professional or | ||||||
| 11 | artistic service
contracts filed under this Section
separately | ||||||
| 12 | from other filed contracts.
| ||||||
| 13 | (e) Method of source selection. When a contract is filed
| ||||||
| 14 | with the Comptroller under this
Section, the Comptroller's file | ||||||
| 15 | shall identify the method of
source selection used in obtaining | ||||||
| 16 | the
contract.
