| AN ACT concerning finance.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Department of Transportation Law of the
|
5 |
| Civil Administrative Code of Illinois is amended by adding |
6 |
| Section 2705-585 as follows: |
7 |
| (20 ILCS 2705/2705-585 new) |

| Sec. 2705-585. Local Government Road Salt Purchase |
9 |
| Reimbursement Fund. |
10 |
| (a) The Local Government Road Salt Purchase Reimbursement |
11 |
| Fund is hereby created as a special fund
in the State treasury. |
12 |
| Subject to appropriation, moneys in the Fund shall be used by |
13 |
| the Department to make grants to counties, municipalities, |
14 |
| townships, and road districts in the northeastern Illinois |
15 |
| region that (i) participated in the original bid process with |
16 |
| the Department of Central Management Services for the purchase |
17 |
| of road salt for the 2008-2009 winter season, (ii) did not |
18 |
| receive a bid during that original bid process, and (iii) |
19 |
| purchased road salt for the 2008-2009 winter season at a rate |
20 |
| that exceeds the Illinois Department of Transportation Road |
21 |
| District 1 average cost of $68.59 per ton. |
22 |
| (b) Grant applications must be submitted within 150 days |
23 |
| after the effective date of this amendatory Act of the 96th |

| General Assembly. Grants shall be awarded in an amount equal to |
2 |
| the difference between (i) the amount of the contract price |
3 |
| negotiated by the Department of Central Management Services or |
4 |
| the county, municipality, township, or road district for only |
5 |
| the tonnage of road salt designated for that county, |
6 |
| municipality, township, or road district in the original |
7 |
| Central Management Services bid process and (ii) $69.00 |
8 |
| multiplied by the tonnage of road salt designated for the |
9 |
| county, municipality, township, or road district in the |
10 |
| original Central Management Services bid process. However, in |
11 |
| no event may a grant award exceed $70.00 multiplied by the |
12 |
| tonnage of road salt designated for that county, municipality, |
13 |
| township, or road district in the original Central Management |
14 |
| Services bid process. Grant amounts may be prorated if moneys |
15 |
| in the Fund are not sufficient to cover the grants awarded. |
16 |
| Grants may be awarded only for the 2008-2009 winter season. |
17 |
| (c) The Secretary of Transportation shall certify to the |
18 |
| Comptroller and Treasurer when all grants have been made for |
19 |
| the 2008-2009 winter season. If any amount then remains in the |
20 |
| Fund, the Comptroller shall order transferred and the Treasurer |
21 |
| shall transfer that amount from the Local Government Road Salt |
22 |
| Purchase Reimbursement Fund to the FY09 Budget Relief Fund, and |
23 |
| the Local Government Road Salt Purchase Reimbursement Fund is |
24 |
| thereupon dissolved.

| Section 10. The State Finance Act is amended by changing |

| Sec. 8.46. Transfers to the FY09 Budget Relief Fund. |

| (a) The FY09 Budget Relief Fund is created as a special |
8 |
| fund in the State Treasury. Amounts may be expended from the |
9 |
| Fund only pursuant to specific authorization by appropriation. |
10 |
| (b) Notwithstanding any other State law to the contrary, |
11 |
| the State Treasurer and State Comptroller are directed to |
12 |
| transfer to the FY09 Budget Relief Fund the following amounts |
13 |
| from the funds specified, in equal quarterly installments with |
14 |
| the first made on the effective date of this amendatory Act of |
15 |
| the 95th General Assembly, or as soon thereafter as practical, |
16 |
| and with the remaining transfers to be made on October 1, 2008, |
17 |
| January 1, 2009, and April 1, 2009, or as soon thereafter as |
18 |
| practical: |

| (c) On and after the effective date of this amendatory Act

| of the 95th General Assembly through June 30, 2009, when any of

| the funds listed in subsection (b) have insufficient cash from
|
9 |
| which the State Comptroller may make expenditures properly
|
10 |
| supported by appropriations from the fund, then the State
|
11 |
| Treasurer and State Comptroller shall transfer from the FY09 |
12 |
| Budget Relief Fund to the fund only such amount as is |
13 |
| immediately
necessary to satisfy outstanding expenditure |
14 |
| obligations on a
timely basis, subject to the provisions of the |
15 |
| State Prompt
Payment Act. All or a portion of the
amounts |
16 |
| transferred from the FY09 Budget Relief
Fund to a fund pursuant |
17 |
| to this subsection (c) from time to
time may
be re-transferred |
18 |
| by the State Comptroller and the
State Treasurer from the |
19 |
| receiving fund into the FY09 Budget Relief Fund as soon as and |
20 |
| to the extent that deposits are
made into or receipts are |
21 |
| collected by the receiving fund.
|
22 |
| (d) As soon as possible after the effective date of this |
23 |
| amendatory Act of the 96th General Assembly, the Comptroller |
24 |
| shall order
transferred and the Treasurer shall transfer |
25 |
| $12,900,000 from the FY09 Budget Relief Fund to the Local |
26 |
| Government Road Salt Purchase Reimbursement Fund. |
