40 ILCS 5/4-139.5 new










    Amends the Downstate Police and Downstate Firefighter Articles of the Illinois Pension Code. Provides that, if not otherwise a party, the municipality is entitled to appear,  as a matter of right, in any proceeding involving a participant or a beneficiary under the Articles that might result in a final administrative decision by the board. Effective immediately.

    AN ACT concerning public employee benefits.

    Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

    Section 5. The Illinois Pension Code is amended  by adding 
5
Sections 3-148.5 and 4-139.5 as follows:

    (40 ILCS 5/3-148.5  new)

    Sec. 3-148.5. Right of employer to intervene. If not 
8
otherwise a party, the municipality is entitled to appear,  as a 
9
matter of right, in any proceeding involving a participant or a 
10
beneficiary under this Article that might result in a final 
11
administrative decision by the board.

    Sec. 4-139.5. Right of employer to intervene. If not

    Section 99. Effective date. This Act takes effect upon

becoming law.
