AMENDMENT TO SENATE BILL 314

    AMENDMENT NO. ______. Amend Senate Bill 314, AS AMENDED, 
3
with reference to page and line numbers of House Amendment No. 
4
1, on page 11, line 20, after the period, by inserting the 
5
following: "The Department may reduce or waive a penalty 
6
pursuant to Section 3-308 only if that action will not threaten 
7
the ability of the Department to meet the expenses required to 
8
be met by the Long Term Care Monitor/Receiver Fund."; and

on page 15, by replacing lines 10 through 20 with the 
10
following:

        "(2) The facility has made a diligent effort to correct 
12
    the violation and to prevent its recurrence. ;
13
        (3) The facility has no record of a pervasive pattern 
14
    of the same or similar violations. ;
15
        (4) The facility did not benefit financially from 
16
    committing or continuing the violation. The facility has a 
17
    record of substantial compliance with this Act and the
