AMENDMENT TO SENATE BILL 737




2    AMENDMENT NO. ______. Amend Senate Bill 737, AS AMENDED, 
3with reference to page and line numbers of Senate Amendment No. 
41 as follows:


 
5on page 270, immediately below line 16, by inserting the 
6following:
7    "(k) Subject to the approval of the Illinois Gaming Board, 
8an organization licensee that (i) receives an electronic gaming 
9license under this Act and (ii) has operating control of a race 
10track facility located in Cook County, may relocate its race 
11track facility within Cook County in conjunction with plans to 
12construct a new structure for purposes of electronic gaming at 
13a location within a 3-mile radius of its existing race track 
14facility. Notwithstanding anything to the contrary in this Act, 
15a race track facility may not be relocated outside of the 
163-mile radius without the written consent of the geographically 
17closest existing race track facility from that planned

1relocation. The relocation must include the race track 
2facility, including the race track operations used to conduct 
3live racing and the planned electronic gaming facility in its 
4entirety. For the purposes of this subsection (k), "race track 
5facility" means all operations conducted on the race track 
6property for which it was awarded a license for pari-mutuel 
7wagering and live racing in the year 2010, except for the real 
8estate itself. The Illinois Gaming Board shall make its 
9decision after consulting with the Illinois Racing Board, and 
10any relocation application shall be subject to all of the 
11provisions of this Act and the Illinois Horse Racing Act of 
121975.".
