AMENDMENT TO SENATE BILL 1013

    AMENDMENT NO. ______. Amend Senate Bill 1013, AS AMENDED, 
3
by inserting the following in its proper numeric sequence in 
4
Article 1:

    "Section 1-30. The Criminal Code of 1961 is amended  by 
6
adding Section 31-4.5 as follows:
 
7
    (720 ILCS 5/31-4.5  new)
8
    Sec. 31-4.5. Making a false statement to a peace officer or 
9
criminal investigative officer.
10
    (a) A person commits the offense of making a false 
11
statement to a peace officer or criminal investigative officer 
12
if:
13
        (1) the person knowingly makes a false statement to a 
14
    peace officer or criminal investigative officer of the 
15
    State or a unit of local
government regarding a
criminal 
16
    matter that the person knows to be under investigation by

    the
officer; and
2
        (2) during the interview, the person is first informed 
3
    by a
prosecutor who is working with the officer on the 
4
    investigation that a
knowing false statement to the officer 
5
    relating to the investigation
would constitute a criminal 
6
    offense.

    (b)  Sentence.  Making a false statement to a peace officer 
8
or criminal investigative officer is a Class 4 felony.".
