| AN ACT concerning regulation.
|

| Be it enacted by the People of the State of Illinois, |

| represented in the General Assembly:
|

| Section 5. The Public Utilities Act is amended by adding |
| 5 |
| Section 16-111.8 as follows:
|

| (220 ILCS 5/16-111.8 new) |
| 7 |
| Sec. 16-111.8. Rate relief; electricity suppliers. Any |
| 8 |
| electric utility providing rate relief pursuant to Section |
| 9 |
| 16-111.5A of this Act shall not deem any residential or |
| 10 |
| non-residential customer to be ineligible to receive that |
| 11 |
| relief solely based upon that customer's purchase of |
| 12 |
| electricity from a supplier other than that electric utility at |
| 13 |
| the time the rate relief is to be credited to that customer.

| Section 99. Effective date. This Act takes effect upon |
| 15 |
| becoming law. |
