| AN ACT concerning regulation.
|

| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|

| Section 5. The Public Utilities Act is amended by adding |
| 5 |
| Section 16-111.8 as follows:
|

| (220 ILCS 5/16-111.8 new) |
| 7 |
| Sec. 16-111.8. Rate relief; electricity suppliers. On and |
| 8 |
| after the effective date of this amendatory Act of the 96th |
| 9 |
| General Assembly, any electric utility providing rate relief |
| 10 |
| pursuant to Section 16-111.5A of this Act shall not deem any |
| 11 |
| residential or non-residential customer to be ineligible to |
| 12 |
| receive that relief solely based upon that customer's purchase |
| 13 |
| of electricity from a supplier other than that electric utility |
| 14 |
| at the time the rate relief is to be credited to that customer. |
| 15 |
| Nothing in this Section shall entitle customers of an electric |
| 16 |
| utility that had been previously deemed ineligible prior to the |
| 17 |
| effective date of this amendatory Act of the 96th General |
| 18 |
| Assembly to become eligible for rate relief credits.

| Section 99. Effective date. This Act takes effect upon |
| 20 |
| becoming law.
