Amends the Election Code. Notwithstanding any law to the contrary, provides that a vacancy in any elective State or local public office shall be filled at a special election if more than 6 months remain of the term of office and if the annual compensation for that office exceeds $21,000. Requires that the election be held 2 months after the vacancy occurs and that candidate petitions be filed within 30 days after the vacancy occurs.

| AN ACT concerning elections.

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|

| Section 5. The Election Code is amended by adding Section |
| 5 |
| 25-6.5 as follows: |
| 6 |
| (10 ILCS 5/25-6.5 new) |

| Sec. 25-6.5. Special elections. Notwithstanding any |
| 8 |
| provision of law to the contrary, a vacancy in any elective |
| 9 |
| State or local public office that occurs more than 6 months |
| 10 |
| before expiration of the term of that office shall be filled at |
| 11 |
| a special election if the annual compensation for that office |
| 12 |
| is more than $21,000. The special election shall be held 2 |
| 13 |
| months after the date the vacancy occurred. Candidates for the |
| 14 |
| office must file nominating petitions within 30 days after the |
| 15 |
| date the vacancy occurred. The office shall be filled by the |
| 16 |
| candidate who receives the greatest number of votes at the |
| 17 |
| special election. That candidate shall take office as soon as |
| 18 |
| he or she receives certification of the election results and |
| 19 |
| shall serve the remainder of the vacated term.
