AMENDMENT TO SENATE BILL 1631

    AMENDMENT NO. ______. Amend Senate Bill 1631, on page 1, 
3
line 5, by deleting "4,"; and
 
4
on page 7, by deleting lines 2 through 9; and
  
5
on page 7, by replacing lines 17 through 21 with the following:

"counterfeit items but no more than $1,000, except as follows 
7
that :
8
        (1)         A person who has a prior conviction for a

violation 
9
    of this Act within the preceding 5

years is guilty of a 
10
    Class 4 felony and shall be

fined at least 50% 25% but no 
11
    more than 100% of

the retail value of all counterfeit 
12
    items.

        (2)         A person who, as a result of the offense, causes


14
    bodily harm to another is guilty of a Class 3 felony and 
15
    shall be fined at least 50% but no more than 100% of the 
16
    retail value of all counterfeit items.

        (3) A person who, as a result of the offense, causes

    serious bodily harm to, or the death of, another

is guilty

    of a Class 2 felony."; and

on page 8, by replacing lines 4 through 8 with the following:
