1 | AN ACT concerning transportation.
| ||||||
2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Vehicle Code is amended by changing | ||||||
5 | Section 11-1420 as follows:
| ||||||
6 | (625 ILCS 5/11-1420) (from Ch. 95 1/2, par. 11-1420)
| ||||||
7 | Sec. 11-1420. Funeral processions.
| ||||||
8 | (a) Funeral processions have the right-of-way at | ||||||
9 | intersections when
vehicles comprising such procession have | ||||||
10 | their headlights and hazard lights lighted,
subject
to the | ||||||
11 | following conditions and exceptions:
| ||||||
12 | 1. Operators of vehicles in a funeral procession shall | ||||||
13 | yield the
right-of-way upon the approach of an authorized | ||||||
14 | emergency vehicle giving an
audible or visible signal;
| ||||||
15 | 2. Operators of vehicles in a funeral procession shall | ||||||
16 | yield the
right-of-way when directed to do so by a traffic | ||||||
17 | officer;
| ||||||
18 | 3. The operator of the leading vehicle in a funeral | ||||||
19 | procession shall
comply with stop signs and traffic control | ||||||
20 | signals but when the leading
vehicle has proceeded across | ||||||
21 | an intersection in accordance with such signal
or after | ||||||
22 | stopping as required by the stop sign, all vehicles in such
| ||||||
23 | procession may proceed without stopping, regardless of the |
| |||||||
| |||||||
1 | sign or signal
and the leading vehicle and the vehicles in | ||||||
2 | procession shall proceed with
due caution.
| ||||||
3 | (b) The operator of a vehicle not in the funeral procession | ||||||
4 | shall not
drive his vehicle in the funeral procession except | ||||||
5 | when authorized to do so
by a traffic officer or when such | ||||||
6 | vehicle is an authorized emergency
vehicle giving audible or | ||||||
7 | visible signal.
| ||||||
8 | (c) Operators of vehicles not a part of a funeral | ||||||
9 | procession may not
form a procession or convoy and have their | ||||||
10 | headlights or hazard lights or both lighted
for the
purpose of | ||||||
11 | securing the right-of-way granted by this Section to funeral
| ||||||
12 | processions.
| ||||||
13 | (d) The operator of a vehicle not in a funeral procession | ||||||
14 | may overtake
and pass the vehicles in such procession if such | ||||||
15 | overtaking and passing can
be accomplished without causing a | ||||||
16 | traffic hazard or interfering with such
procession.
| ||||||
17 | (e) The lead vehicle in the funeral procession may be | ||||||
18 | equipped with a
flashing amber light which may be used only | ||||||
19 | when such vehicle is used as a
lead vehicle in such procession. | ||||||
20 | Vehicles comprising a funeral procession
may utilize funeral | ||||||
21 | pennants or flags or windshield stickers or flashing
hazard | ||||||
22 | warning signal flashers to identify
the individual vehicles in | ||||||
23 | such a procession.

24 | (f) In the absence of law enforcement traffic control | ||||||
25 | assistance for a funeral procession, a funeral director or his | ||||||
26 | or her designee may direct
traffic during a funeral procession. |
