| 1, on page 2, by replacing lines 9 through 13 with the |

| following: |

| "imposed upon the licensed owner conducting gambling. If the |

| licensed owner of a riverboat in operation on January 1, 2009 |
| 8 |
| has capital projects of at least $45,000,000 that are approved |
| 9 |
| by the Board in calendar years 2006 through 2009 or for which |
| 10 |
| at least $45,000,000 in expenditures have been made in calendar |
| 11 |
| years 2006 through 2009, then no admissions tax is imposed on |
| 12 |
| admissions to that riverboat.".
