| AMENDMENT TO SENATE BILL 1959

| AMENDMENT NO. ______. Amend Senate Bill 1959, AS AMENDED, |

| by replacing everything after the enacting clause with the |
| 4 |
| following:
|

| Section 5. If and only if House Bill 2424 of the 96th |
| 7 |
| General Assembly becomes law, then the Public Utilities Act is |
| 8 |
| amended by repealing Section 8-511.
|

| Section 10. If and only if House Bill 2424 of the 96th |
| 10 |
| General Assembly becomes law, then the Park and Recreational |
| 11 |
| Facility Construction Act is amended by changing Sections 20-5 |
| 12 |
| and 20-10 as follows:
|

| Sec. 20-5. Definitions. As used in this Act: |
| 15 |
| "Department" means the Department of Natural Resources. |

| "Grant index" means a figure for each park or recreation |
| 2 |
| unit equal to one minus the
ratio of the park or recreation |
| 3 |
| unit's equalized assessed valuation per capita to the equalized |
| 4 |
| assessed valuation per capita of the park or recreation unit |
| 5 |
| located at the 90th percentile for all park or recreation units |
| 6 |
| in the State. The grant index shall be no less than 0.35 and no |
| 7 |
| greater than
0.75 for each park or recreation unit; provided |
| 8 |
| that the grant index for park or recreation units whose
|
| 9 |
| equalized assessed valuation per capita is at the
99th |
| 10 |
| percentile and above for all park or recreation units in the |
| 11 |
| State shall be 0.00. |
| 12 |
| "Park or recreation unit" means the governmental unit of |
| 13 |
| any public park, park district, park and recreation district, |
| 14 |
| recreational facility, or recreation system established under |
| 15 |
| the Park District Code, the Chicago Park District Act, the |
| 16 |
| Metro-East Park and Recreation District Act, or the Illinois |
| 17 |
| Municipal Code or the governmental unit of a forest preserve |
| 18 |
| district established under the Downstate Forest Preserve |
| 19 |
| District Act that maintains a zoological park pursuant to the |
| 20 |
| Forest Preserve Zoological Parks Act.

| 21 |
| "Park or recreation unit construction project" means the |
| 22 |
| acquisition, development,
construction, reconstruction, |
| 23 |
| rehabilitation, improvement, architectural
planning, |
| 24 |
| installation, maintenance, and upkeep of (i) capital |
| 25 |
| facilities consisting of buildings,
structures, durable |
| 26 |
| equipment, and land for park or recreation purposes, and (ii) |

| open spaces and natural areas, as those terms are defined in |
| 2 |
| Section 10 of the Illinois Open Land Trust Act, and (iii) |
| 3 |
| zoological parks established under the Forest Preserve |
| 4 |
| Zoological Parks Act.

| Sec. 20-10. Grant awards. The Department is authorized to
|
| 8 |
| make grants to park or recreation units for park or recreation |
| 9 |
| unit construction projects with funds
appropriated for that |
| 10 |
| purpose from the Build Illinois Bond Fund. However, in the case |
| 11 |
| of a park or recreation unit that is a forest preserve |
| 12 |
| district, the Department is not authorized to make grants for |
| 13 |
| purposes other than those enumerated in the Forest Preserve |
| 14 |
| Zoological Parks Act.

| Section 99. Effective date. This Act takes effect upon |
| 17 |
| becoming law.".
