SYNOPSIS AS INTRODUCED:
 
70 ILCS 605/6-1   from Ch. 42, par. 6-1

    Amends the Illinois Drainage Code. Provides that the commissioners of a drainage district must advertise for bids whenever the cost of any work to be performed by the district or the cost of specified materials and equipment exceeds $20,000 (now, $5,000). Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Drainage Code is amended by
5 changing Section 6-1 as follows:
 
6     (70 ILCS 605/6-1)  (from Ch. 42, par. 6-1)
7     Sec. 6-1. Advertising for Bids on Construction Work and
8 Purchases.) Whenever the cost of any work to be performed by
9 the district or the cost of any machinery, equipment, materials
10 or supplies to be purchased by the district will exceed $20,000
11 $5,000, the commissioners shall advertise for sealed bids for
12 the performance of such work or the furnishing of such
13 machinery, equipment, materials or supplies by publishing a
14 notice in a newspaper published or having general circulation
15 in the county in which the district was organized not less than
16 once each week for 3 successive weeks. The first such
17 publication shall be made not less than 17 days prior to the
18 date set for opening the bids. The notice shall particularly
19 set out the time when and the place where the bids will be
20 opened, the nature of the work to be performed or the
21 machinery, equipment, materials or supplies to be purchased and
22 the terms of payment. The commissioners may reject any and all
23 bids, may waive any informality in bids received and may

1 continue the letting from time to time. The commissioners may
2 accept any bid they deem most favorable, but if the bid
3 accepted is not the lowest bid, they shall enter in their
4 minutes their reason for not accepting the lower bid or bids.
5 If any person to whom a contract has been let after notice as
6 herein required fails to perform his contract, the same may be
7 relet in such a manner as the commissioners deem best, with or
8 without advertisement for bids.
9     The provisions of this Section, however, shall not apply to
10 the contracting, letting or doing of any repair or maintenance
11 work the cost of which will be payable from the annual
12 maintenance fund of the district.

14     Section 99. Effective date. This Act takes effect upon
15 becoming law.
