SYNOPSIS AS INTRODUCED:
 
20 ILCS 405/405-335 new

    Amends the Department of Central Management Services Law. Requires the Department to establish and maintain a website known as the Illinois Accountability Portal. The website shall provide direct access to information concerning State employees and individual consultants, State expenditures, State tax credits, State contracts, and revocations and suspensions of occupation and use tax certificates of registration and professional licenses.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Central Management Services
5 Law of the Civil Administrative Code of Illinois is amended by
6 adding Section 405-335 as follows:
 
7     (20 ILCS 405/405-335 new)
8     Sec. 405-335. Illinois Accountability Portal.
9     (a) To establish and maintain a website, known as the
10 Illinois Accountability Portal, with a full-time webmaster.
11     (b) As used in this Section:
12     "Director" means the Director of Central Management
13 Services.
14     "Funding action or expenditure" includes details on the
15 type of spending (grant, contract, appropriation, etc.). The
16 term includes tax exemptions, credits, and deductions.
17     "Funding source" means the State account from which the
18 expenditure is appropriated.
19     "State audit or report" includes any audit or report issued
20 by the Auditor General relating to the recipient of funds or
21 the budgetary program, activity, or agency.
22     (c) The website shall provide direct access to each of the
23 following:

1         (1) A database of all current State employees and
2     individual consultants, sorted separately by name, agency,
3     and position title, listing for each their current pay rate
4     and year-to-date pay.
5         (2) A database of all current State expenditures,
6     sorted separately by agency, category, customer, and
7     Representative District.
8         (3) A database of all current State tax credits, sorted
9     separately by tax credit category, customer, and
10     Representative District.
11         (4) A database of all revocations and suspensions of
12     State occupation and use tax certificates of registration
13     and all revocations and suspensions of State professional
14     licenses, sorted separately by name, geographic location,
15     and certificate of registration number or license number,
16     as applicable. Professional license revocations and
17     suspensions shall be posted only if resulting from a
18     failure to pay taxes, license fees, or child support.
19         (5) A database of all current State contracts, sorted
20     separately by contractor name, awarding officer or agency,
21     contract value, and goods or services provided.
22     (d) Any database created shall allow public access at no
23 cost to search and aggregate information.
24     (e) Searchable data maintained shall include, but not be
25 limited to, the following:
26         (1) name and principal location or residence of the

1     entity receiving State funds;
2         (2) amount of funds expended;
3         (3) funding or expending agency;
4         (4) funding source of the revenue expended;
5         (5) budgetary program or activity of the expenditure;
6         (6) descriptive purpose for the funding action or
7     expenditure;
8         (7) expected performance outcome for the funding
9     action or expenditure;
10         (8) past performance outcomes achieved for the funding
11     action or expenditure; and
12         (9) any related State audit or report.
13     (f) The Director shall not be considered in compliance with
14 this Section if (i) the data required to be maintained on a
15 searchable database are not available in a searchable and
16 aggregate manner or (ii) the public is redirected to other
17 government websites, unless each of those sites has information
18 from all agencies of the State and each category of information
19 required can be searched electronically by field in a single
20 search.
