| AMENDMENT NO. ______. Amend Senate Bill 2121 by replacing |

| lines 16 through 20 on page 6 with the following: |

| "industrial storm water, the fee is $500. |
| 5 |
| (10) for NPDES permits for construction site storm |
| 6 |
| water, the fee: |
| 7 |
| (A) for applications received before January 1, |
| 8 |
| 2010 is $500; |
| 9 |
| (B) for applications received on or after January |
| 10 |
| 1, 2010 is: |
| 11 |
| (i) $250 if less than 5 acres are disturbed; |
| 12 |
| and |
| 13 |
| (ii) $750 if 5 or more acres are disturbed.".
