SYNOPSIS AS INTRODUCED:
 
20 ILCS 1805/22-9

    Amends the Military Code of Illinois. Authorizes the Department of Military Affairs, subject to appropriation, to also make grants from the Illinois Military Family Relief Fund to (i) Illinois residents who are active duty members of the armed forces of the United States or members of the reserves of the armed forces of the United States and who are wounded in combat while deployed in support of the global war on terrorism and (ii) the families of those persons. Provides that the Department must establish a casualty-based grant program.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Military Code of Illinois is amended by
5 changing Section 22-9 as follows:
 
6     (20 ILCS 1805/22-9)
7     Sec. 22-9. Power to make grants from the Illinois Military
8 Family Relief Fund. Subject to appropriation, the Department of
9 Military Affairs shall have the power to make grants from the
10 Illinois Military Family Relief Fund, a special fund created in
11 the State treasury, to (i) single persons who are members of
12 the Illinois National Guard, (ii) or Illinois residents who are
13 members of the reserves of the armed forces of the United
14 States and who have been called to active duty as a result of
15 the September 11, 2001 terrorist attacks, (iii) Illinois
16 residents who are active duty members of the armed forces of
17 the United States or members of the reserves of the armed
18 forces of the United States and who are wounded in combat while
19 deployed in support of the global war on terrorism, and (iv)
20 families of the classes of persons listed in items (i), (ii),
21 and (iii) of this Section and to families of persons who are
22 members of the Illinois National Guard or Illinois residents
23 who are members of the reserves of the armed forces of the

1 United States and who have been called to active duty as a
2 result of the September 11, 2001 terrorist attacks. The
3 Department of Military Affairs shall establish eligibility
4 criteria for the grants by rule.
5     The Department of Military Affairs shall establish a
6 casualty-based grant program and criteria for awarding grants
7 under that program. The Department may consider past and
8 present members of the Illinois National Guard who were wounded
9 in combat and Illinois residents who were wounded in combat and
10 who are or were active duty or reserve members of the armed
11 forces of the United States for these grants. The Department
12 must award at least $5,000 to each recipient of a
13 casualty-based grant.
14     In addition to amounts transferred into the Fund under
15 Section 510 of the Illinois Income Tax Act, the State Treasurer
16 shall accept and deposit into the Fund all gifts, grants,
17 transfers, appropriations, and other amounts from any legal
18 source, public or private, that are designated for deposit into
19 the Fund.
