  from Ch. 108 1/2, par. 16-121








     Amends the Downstate Teacher Article of the Illinois Pension Code. Includes within the definition of "salary" any stipend awarded to a National Board Certified teacher (regardless of whether the teacher actually receives the stipend or the stipend is prorated due to budgetary reasons). Effective immediately.

    AN ACT concerning public employee benefits.

    Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

    Section 5. The Illinois Pension Code is amended  by changing 
5
Section 16-121 as follows:

    Sec. 16-121. Salary. "Salary": The actual compensation 
8
received by a teacher during any
school year and recognized by 
9
the system in accordance with
rules of the board and any 
10
stipend awarded to a National Board Certified teacher 
11
(regardless of whether the teacher actually receives the 
12
stipend or the stipend is prorated due to budgetary reasons). 
13
For purposes of this Section, "school year" includes
the 
14
regular school term plus any additional period for which a 
15
teacher is
compensated and such compensation is recognized by 
16
the rules of the board.
