2 | AMENDMENT NO. ______. Amend Senate Bill 2632 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 1. Short title. This Act may be cited as the | ||||||
5 | Public Land Pack and Saddle Animal Access Act. | ||||||
6 | Section 5. Definitions. In this Act: | ||||||
7 | "Pack animal" means a beast of burden, such as a horse, | ||||||
8 | mule, donkey, or llama, used as a means of transporting | ||||||
9 | materials. | ||||||
10 | "Public land" means land that is open to the general public | ||||||
11 | and is owned or managed by the State. | ||||||
12 | "Saddle animal" means an animal, such as a horse, that is | ||||||
13 | ridden. | ||||||
14 | Section 10. Access to public land. In maintaining public | ||||||
15 | land, the Department of Natural Resources, or other designated |

1 | agency, shall preserve and facilitate continued use of and | ||||||
2 | access to public land by pack and saddle animals where such use | ||||||
3 | is currently authorized. | ||||||
4 | Section 15. Trail closure. | ||||||
5 | (a) The Department of Natural Resources, or other | ||||||
6 | designated agency, may implement a reduction in access to a | ||||||
7 | trail by pack and saddle animals under the following | ||||||
8 | conditions:

9 | (1) where conditions are not suitable because of | ||||||
10 | significant public safety concerns or where necessary for | ||||||
11 | maintenance; or
| ||||||
12 | (2) for reasons related to the mission of the | ||||||
13 | Department of Natural Resources or other designated | ||||||
14 | agency.
| ||||||
15 | (b) If a trail closure or other reduction is implemented | ||||||
16 | under this Section, such closure or reduction shall be posted | ||||||
17 | at the trailhead.
| ||||||
18 | (c) Nothing in this Section alters or limits the State's | ||||||
19 | authority to implement a temporary emergency closure of a trail | ||||||
20 | or road to pack and saddle animals.".
