| AMENDMENT TO SENATE BILL 3070

| AMENDMENT NO. ______. Amend Senate Bill 3070 as follows:

| on page 2, by replacing lines 14 and 15 with the following: |
| 4 |
| "level and the Agency issues a notice under subdivision |
| 5 |
| (a)(2)(B) of Section 25d-3 of this Act based on the presence of |
| 6 |
| the carcinogenic volatile organic compound, the owner or |
| 7 |
| operator of the community water system shall, within 45 days |
| 8 |
| after the date the Agency issues the notice under subdivision |
| 9 |
| (a)(2)(B) of Section 25d-3 of this Act, submit to the Agency a |
| 10 |
| response plan"; and
|
| 11 |
| on page 2, by replacing line 20 with the following: |
| 12 |
| "in the finished water. The response plan shall also include |
| 13 |
| periodic sampling designed to measure and verify the |
| 14 |
| effectiveness of the response plan."; and
|
| 15 |
| on page 2,
by replacing line 23 with the following: |

| "system shall implement the plan. The owner or operator |
| 2 |
| shall"; and
|

| on page 2, line 26, by replacing "must" with "shall"; and
|

| on page 3, immediately below line 6, by inserting the |
| 5 |
| following: |

| "(3) In approving, modifying, or denying a plan |
| 7 |
| required under this Section, the Agency shall take into |
| 8 |
| account the technical feasibility and economic |
| 9 |
| reasonableness of the plan and any modification to the |
| 10 |
| plan. |
| 11 |
| (d)(1) No person required to submit a response plan under |
| 12 |
| subsection (c) of this Section shall fail to submit the |
| 13 |
| plan in accordance with the requirements of subsection (c). |
| 14 |
| (2) No person required to implement a response plan |
| 15 |
| under subdivision (c)(1) of this Section shall fail to |
| 16 |
| implement the plan in accordance with the requirements of |
| 17 |
| subdivision (c)(1). |
| 18 |
| (3) No person required to submit a status report or a |
| 19 |
| response completion report under subdivision(c)(1) of this |
| 20 |
| Section shall fail to submit the report in accordance with |
| 21 |
| the requirements of subdivision (c)(1).".
