AMENDMENT TO SENATE BILL 3085

2     AMENDMENT NO. ______. Amend Senate Bill 3085 by replacing
3 everything after the enacting clause with the following:
 
4     "(705 ILCS 405/5-121 rep.)
5     Section 5.The Juvenile Court Act of 1987 is amended by
6 repealing Section 5-121.
 
7     Section 10. The Unified Code of Corrections is amended by
8 changing Section 3-2.5-65 as follows:
 
9     (730 ILCS 5/3-2.5-65)
10     Sec. 3-2.5-65. Juvenile Advisory Board.
11     (a) There is created a Juvenile Advisory Board composed of
12 11 persons, appointed by the Governor to advise the Director on
13 matters pertaining to juvenile offenders. The members of the
14 Board shall be qualified for their positions by demonstrated
15 interest in and knowledge of juvenile correctional work

1 consistent with the definition of purpose and mission of the
2 Department in Section 3-2.5-5 and shall not be officials of the
3 State in any other capacity. The members under this amendatory
4 Act of the 94th General Assembly shall be appointed as soon as
5 possible after the effective date of this amendatory Act of the
6 94th General Assembly and be appointed to staggered terms 3
7 each expiring in 2007, 2008, and 2009 and 2 of the members'
8 terms expiring in 2010. Thereafter all members will serve for a
9 term of 6 years, except that members shall continue to serve
10 until their replacements are appointed. Any vacancy occurring
11 shall be filled in the same manner for the remainder of the
12 term. The Director of Juvenile Justice shall be an ex officio
13 member of the Board. The Board shall elect a chair from among
14 its appointed members. The Director shall serve as secretary of
15 the Board. Members of the Board shall serve without
16 compensation but shall be reimbursed for expenses necessarily
17 incurred in the performance of their duties. The Board shall
18 meet quarterly and at other times at the call of the chair.
19     (b) The Board shall:
20         (1) Advise the Director concerning policy matters and
21     programs of the Department with regard to the custody,
22     care, study, discipline, training, and treatment of
23     juveniles in the State juvenile correctional institutions
24     and for the care and supervision of juveniles released on
25     parole.
26         (2) Establish, with the Director and in conjunction

1     with the Office of the Governor, outcome measures for the
2     Department in order to ascertain that it is successfully
3     fulfilling the mission mandated in Section 3-2.5-5 of this
4     Code. The annual results of the Department's work as
5     defined by those measures shall be approved by the Board
6     and shall be included in an annual report transmitted to
7     the Governor and General Assembly jointly by the Director
8     and the Board.
9         (3) Study the impact of, develop timelines, and propose
10     a funding structure to accommodate the expansion of the
11     jurisdiction of the Illinois Juvenile Court to include
12     youth age 17 under the jurisdiction of the Juvenile Court
13     Act of 1987. The Board shall submit a report by December 1,
14     2010 to the General Assembly with recommendations on
15     extending juvenile court jurisdiction to youth age 17
16     charged with felony offenses.
17     (c) On the effective date of this amendatory Act of the
18 96th General Assembly, the Illinois Juvenile Jurisdiction Task
19 Force created by Public Act 95-1031 is abolished and its duties
20 are transferred to the Juvenile Advisory Board as provided in
21 paragraph (3) of subsection (b).

23     Section 99. Effective date. This Act takes effect upon
24 becoming law.".
