AMENDMENT TO SENATE BILL 3146

    AMENDMENT NO. ______. Amend Senate Bill 3146, AS AMENDED,

with reference to page and line numbers of House Amendment No. 
4
2, on page 3, immediately below line 16, by inserting the 
5
following:

    "Section 2. The State Finance Act is amended by changing 
7
Section 6z-77 as follows:
 
8
    (30 ILCS 105/6z-77)
9
    Sec. 6z-77. The Capital Projects Fund. The Capital Projects 
10
Fund is created as a special fund in the State Treasury. The 
11
State Comptroller and State Treasurer shall transfer from the 
12
Capital Projects Fund to the General Revenue Fund $61,294,550 
13
on October 1, 2009, $122,589,100 on January 1, 2010, and 
14
$61,294,550 on April 1, 2010. Beginning on July 1, 2010, and on 
15
July 1 and January 1 of each year thereafter, the State 
16
Comptroller and State Treasurer shall transfer the sum of

$122,589,100 from the Capital Projects Fund to the General 
2
Revenue Fund.  Subject to appropriation, the Capital Projects 
3
Fund may be used only for capital projects and the payment of 
4
debt service on bonds issued for capital projects. If moneys 
5
have been deposited into the Fund pursuant to Section 7.6, 12, 
6
or 13 of the Riverboat Gambling Act that are not necessary for 
7
the purposes of the Fund, as determined jointly by the State 
8
Treasurer and State Comptroller, then, on at least an annual 
9
basis, the State Comptroller shall order and the State 
10
Treasurer shall transfer that excess amount from the Fund to 
11
the Education Assistance Fund. All interest earned on moneys in 
12
the Fund shall be deposited into the Fund.  The Fund shall not 
13
be subject to administrative charges or chargebacks, such as 
14
but not limited to those authorized under Section 8h.
