AMENDMENT TO SENATE BILL 3263

    AMENDMENT NO. ______. Amend Senate Bill 3263 by replacing

everything after the enacting clause with the following:

    "Section 5. The Department of Transportation Law of the

5
Civil Administrative Code of Illinois is amended  by changing 
6
Section 2705-15 as follows:
 
7
    (20 ILCS 2705/2705-15)  (was 20 ILCS 2705/49 and 49.23)
8
    Sec. 2705-15. Administrative organization. 
9
    (a) The Secretary may
create and establish offices, 
10
divisions, and administrative units as
necessary for the 
11
efficient administration and operation of the
Department and 
12
may assign functions, powers, and duties to the several

13
offices, divisions, and administrative units in the 
14
Department.

    (b) The Department has the power to establish the 
16
administrative
organization within the
Department that
is

required to carry out the powers, duties, and functions of the

2
Department and best utilize the personnel, skills, facilities, 
3
and
resources
of the Department and its offices, divisions, and 
4
agencies.

    (c) The Department shall divide the State into not more 
6
than 2 highway districts for the purpose of funding the 
7
maintenance, construction, design, and administration of 
8
highways and highway facilities within each district. The 
9
Department shall divide the highway districts as follows:
10
        (1) District 1 shall consist of the counties of Cook, 
11
    DuPage, Kane, lake, McHenry, and Will; and 
12
        (2) District 2 shall consist of all other counties not 
13
    listed in paragraph (1) of this subsection. 
14
