AMENDMENT TO SENATE BILL 3347

    AMENDMENT NO. ______. Amend Senate Bill 3347, AS AMENDED, 
3
by replacing everything after the enacting clause with the 
4
following:

    "Section 5. The Environmental Protection Act is amended  by 
6
adding Section 22.23c as follows:
 
7
    (415 ILCS 5/22.23c new)
8
    Sec. 22.23c. Vehicle wheel weights. 
9
    (a) In this Section:
10
        "New vehicle" has the same meaning as ascribed in 
11
    Section 1-148.4 of the Illinois Vehicle Code.
12
        "Vehicle" has the same meaning as ascribed  in Section 
13
    1-217 of the Illinois Vehicle Code.
14
    (b) On and after January 1, 2012, no person shall use a 
15
weight or other product to balance a vehicle wheel or tire if 
16
the weight or other product contains mercury that was

intentionally added during the manufacturing process or 
2
contains more than 0.1 percent lead by weight.

    (c) On and after January 1, 2012, no person shall sell, 
4
offer to sell, distribute, or offer to distribute a weight or 
5
other product for balancing a vehicle wheel or tire if the 
6
weight or other product contains mercury that was intentionally 
7
added during the manufacturing process or contains more than 
8
0.1 percent lead by weight.

    (d) On and after January 1, 2012, no person shall sell a 
10
new vehicle equipped with a weight or other product used to 
11
balance a vehicle wheel or tire if the weight or other product 
12
contains  mercury that was intentionally added during the 
13
manufacturing process or contains more than 0.1 percent lead by 
14
weight.

    Section 99. Effective date. This Act takes effect upon 
16
becoming law.".
