1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Downstate Public Transportation Act is
5amended by changing Section 2-15.2 as follows:
 
6    (30 ILCS 740/2-15.2)
7    Sec. 2-15.2. Free services; eligibility.
8    (a) Notwithstanding any law to the contrary, no later than
960 days following the effective date of this amendatory Act of
10the 95th General Assembly and until subsection (b) is
11implemented, any fixed route public transportation services
12provided by, or under grant or purchase of service contracts
13of, every participant, as defined in Section 2-2.02 (1)(a),
14shall be provided without charge to all senior citizen
15residents of the participant aged 65 and older, under such
16conditions as shall be prescribed by the participant.
17    (b) Notwithstanding any law to the contrary, no later than
18180 days following the effective date of this amendatory Act of
19the 96th General Assembly, any fixed route public
20transportation services provided by, or under grant or purchase
21of service contracts of, every participant, as defined in
22Section 2-2.02 (1)(a), shall be provided without charge to
23senior citizens aged 65 and older who meet the income

1eligibility limitation set forth in subsection (a-5) of Section
24 of the Senior Citizens and Disabled Persons Property Tax
3Relief and Pharmaceutical Assistance Act, under such
4conditions as shall be prescribed by the participant. The
5Department on Aging shall furnish all information reasonably
6necessary to determine eligibility, including updated lists of
7individuals who are eligible for services without charge under
8this Section. Nothing in this Section shall relieve the
9participant from providing reduced fares as may be required by
10federal law.

12    Section 10. The Metropolitan Transit Authority Act is
13amended by changing Section 51 as follows:

15    Sec. 51. Free services; eligibility.
16    (a) Notwithstanding any law to the contrary, no later than
1760 days following the effective date of this amendatory Act of
18the 95th General Assembly and until subsection (b) is
19implemented, any fixed route public transportation services
20provided by, or under grant or purchase of service contracts
21of, the Board shall be provided without charge to all senior
22citizens of the Metropolitan Region (as such term is defined in
2370 ILCS 3615/1.03) aged 65 and older, under such conditions as
24shall be prescribed by the Board.

1    (b) Notwithstanding any law to the contrary, no later than
2180 days following the effective date of this amendatory Act of
3the 96th General Assembly, any fixed route public
4transportation services provided by, or under grant or purchase
5of service contracts of, the Board shall be provided without
6charge to senior citizens aged 65 and older who meet the income
7eligibility limitation set forth in subsection (a-5) of Section
84 of the Senior Citizens and Disabled Persons Property Tax
9Relief and Pharmaceutical Assistance Act, under such
10conditions as shall be prescribed by the Board. The Department
11on Aging shall furnish all information reasonably necessary to
12determine eligibility, including updated lists of individuals
13who are eligible for services without charge under this
14Section. Nothing in this Section shall relieve the Board from
15providing reduced fares as may be required by federal law.

17    Section 15. The Local Mass Transit District Act is amended
18by changing Section 8.6 as follows:

20    Sec. 8.6. Free services; eligibility.
21    (a) Notwithstanding any law to the contrary, no later than
2260 days following the effective date of this amendatory Act of
23the 95th General Assembly and until subsection (b) is
24implemented, any fixed route public transportation services

1provided by, or under grant or purchase of service contracts
2of, every District shall be provided without charge to all
3senior citizens of the District aged 65 and older, under such
4conditions as shall be prescribed by the District.
5    (b) Notwithstanding any law to the contrary, no later than
6180 days following the effective date of this amendatory Act of
7the 96th General Assembly, any fixed route public
8transportation services provided by, or under grant or purchase
9of service contracts of, every District shall be provided
10without charge to senior citizens aged 65 and older who meet
11the income eligibility limitation set forth in subsection (a-5)
12of Section 4 of the Senior Citizens and Disabled Persons
13Property Tax Relief and Pharmaceutical Assistance Act, under
14such conditions as shall be prescribed by the District. The
15Department on Aging shall furnish all information reasonably
16necessary to determine eligibility, including updated lists of
17individuals who are eligible for services without charge under
18this Section. Nothing in this Section shall relieve the
19District from providing reduced fares as may be required by
20federal law.

22    Section 20. The Regional Transportation Authority Act is
23amended by changing Sections 3A.15 and 3B.14 as follows:

1    Sec. 3A.15. Free services; eligibility.
2    (a) Notwithstanding any law to the contrary, no later than
360 days following the effective date of this amendatory Act of
4the 95th General Assembly and until subsection (b) is
5implemented, any fixed route public transportation services
6provided by, or under grant or purchase of service contracts
7of, the Suburban Bus Board shall be provided without charge to
8all senior citizens of the Metropolitan Region aged 65 and
9older, under such conditions as shall be prescribed by the
10Suburban Bus Board.
11    (b) Notwithstanding any law to the contrary, no later than
12180 days following the effective date of this amendatory Act of
13the 96th General Assembly, any fixed route public
14transportation services provided by, or under grant or purchase
15of service contracts of, the Suburban Bus Board shall be
16provided without charge to senior citizens aged 65 and older
17who meet the income eligibility limitation set forth in
18subsection (a-5) of Section 4 of the Senior Citizens and
19Disabled Persons Property Tax Relief and Pharmaceutical
20Assistance Act, under such conditions as shall be prescribed by
21the Suburban Bus Board. The Department on Aging shall furnish
22all information reasonably necessary to determine eligibility,
23including updated lists of individuals who are eligible for
24services without charge under this Section. Nothing in this
25Section shall relieve the Suburban Bus Board from providing
26reduced fares as may be required by federal law.

12Commuter Rail Board.
13    (b) Notwithstanding any law to the contrary, no later than
14180 days following the effective date of this amendatory Act of
15the 96th General Assembly, any fixed route public
16transportation services provided by, or under grant or purchase
17of service contracts of, the Commuter Rail Board shall be
18provided without charge to senior citizens aged 65 and older
19who meet the income eligibility limitation set forth in
20subsection (a-5) of Section 4 of the Senior Citizens and
21Disabled Persons Property Tax Relief and Pharmaceutical
22Assistance Act, under such conditions as shall be prescribed by
23the Commuter Rail Board. The Department on Aging shall furnish
24all information reasonably necessary to determine eligibility,
25including updated lists of individuals who are eligible for

5    Section 99. Effective date. This Act takes effect upon
