AMENDMENT TO HOUSE BILL 77 




2    AMENDMENT NO. ______. Amend House Bill 77 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Personnel Code is amended  by adding Section 
58g as follows:
 
6    (20 ILCS 415/8g new)
7    Sec. 8g. State Employee Commuter Vehicle Registration.
8    (a) As used in this Section, unless the context otherwise 
9requires:
10    "Commuter vehicle" means any automobile, truck, or 
11motorcycle leased or owned in whole or part by a State employee 
12and used by that employee to commute to or from employment with 
13a State agency.
14    "State agency" means any entity included in the definition 
15of "State agencies" in Section 1-7 of the Illinois State 
16Auditing Act.

1    "State employee" means a person employed by a State agency 
2whose relationship with that agency constitutes an 
3employer-employee relationship under the usual common law 
4rules, and who is not an independent contractor.
5    (b) Each current State employee who has been employed by a 
6State agency for more than one year must, within 60 days after 
7the date of his or her one-year service anniversary with that 
8agency or within 60 days after the effective date of this Act, 
9whichever is later, be able to furnish, upon demand by the head 
10of personnel at the facility where the State employee is 
11employed, evidence that he or she has registered his or her 
12commuter vehicle with the State.
 

13    Section 99. Effective date. This Act takes effect upon 
14becoming law.".
