| 1 | | AN ACT concerning education.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The School Code is amended by adding Section |
| 5 | | 34-18.45 as follows:
|
| 6 | | (105 ILCS 5/34-18.45 new) |
| 7 | | Sec. 34-18.45. Recess required in elementary school. The |
| 8 | | board shall require that schools provide daily recess for all |
| 9 | | students in kindergarten through grade 8. A recess must be at |
| 10 | | least 10 minutes in length. If the principal determines that |
| 11 | | the weather is inclement, the principal shall direct that a |
| 12 | | recess be held indoors. The principal shall ensure that |
| 13 | | students are given the opportunity to engage in physical |
| 14 | | exercise during each recess. The time required for recesses by |
| 15 | | this Section is included in the minimum number of hours |
| 16 | | necessary to constitute a full day of attendance under Section |
| 17 | | 18-8.05 of this Code.
