2 | AMENDMENT NO. ______. Amend House Bill 440 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Illinois Latino Family Commission Act is | ||||||
5 | amended by adding Section 35 as follows: | ||||||
6 | (20 ILCS 3983/35 new) | ||||||
7 | Sec. 35. The Secure Communities Action Task Force; | ||||||
8 | suspension of Secure Communities Memorandum of Agreement. | ||||||
9 | (a) The Secure Communities Memorandum of Agreement between | ||||||
10 | the State and the federal Immigration and Customs Enforcement | ||||||
11 | Agency is aimed at removing undocumented individuals who have | ||||||
12 | committed serious criminal offenses. Current data suggests | ||||||
13 | that between 44% and 78% of undocumented individuals detained | ||||||
14 | by law enforcement in Illinois were not detained on criminal | ||||||
15 | charges; the national average is 27%. This disparity suggests | ||||||
16 | that current implementation efforts are not aligned with the |

1 | purpose of the program and result in an unnecessary burden to | ||||||
2 | jails and local taxpayers and decreased security statewide. | ||||||
3 | Therefore, the Secure Communities Memorandum of Agreement is | ||||||
4 | hereby suspended until a study is conducted by the Secure | ||||||
5 | Communities Action Task Force created in subsection (b) of this | ||||||
6 | Section. | ||||||
7 | (b) The Secure Communities Action Task Force is hereby | ||||||
8 | created. The Task Force shall consist of 9 members appointed as | ||||||
9 | follows: one member appointed by the Senate President; one | ||||||
10 | member appointed by the Senate Minority Leader; one member | ||||||
11 | appointed by the Speaker of the House of Representatives; one | ||||||
12 | member appointed by the House Minority Leader; one member, to | ||||||
13 | serve as chair, appointed by the Governor; and 4 members | ||||||
14 | appointed by the Illinois Latino Family Commission. The members | ||||||
15 | shall be appointed within 30 days after the effective date of | ||||||
16 | this amendatory Act of the 97th General Assembly. Membership of | ||||||
17 | the Secure Communities Action Task Force shall be | ||||||
18 | representative of law enforcement, affected communities, and | ||||||
19 | immigration and human rights advocacy groups. Members shall | ||||||
20 | serve without compensation, but may be reimbursed for expenses | ||||||
21 | associated with the Secure Communities Task Force. The Secure | ||||||
22 | Communities Task Force may accept donated services and other | ||||||
23 | resources that may be necessary to complete the work of the | ||||||
24 | Task Force from not-for-profit organizations. The Office of the | ||||||
25 | Governor shall provide administrative and other support to the | ||||||
26 | Task Force. The Secure Communities Action Task Force shall |

1 | begin to conduct business upon the appointment of all members. | ||||||
2 | The Secure Communities Action Task Force shall review data and | ||||||
3 | conduct additional investigations concerning the Secure | ||||||
4 | Communities Memorandum of Agreement, including hearings in | ||||||
5 | participating counties, and shall report its findings and | ||||||
6 | recommendations to the Governor and the General Assembly no | ||||||
7 | later than June 30, 2012. The Task Force is dissolved upon | ||||||
8 | submission of the report. | ||||||
9 | Section 99. Effective date. This Act takes effect upon | ||||||
10 | becoming law.".
