| 1 | | AN ACT concerning criminal law.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Criminal Code of 1961 is amended by adding |
| 5 | | Section 21-1.6 as follows: |
| 6 | | (720 ILCS 5/21-1.6 new) |
| 7 | | Sec. 21-1.6. Domestic damage to property. |
| 8 | | (a) A person commits domestic damage to property when he or |
| 9 | | she knowingly or intentionally causes damage to a family or |
| 10 | | household member's personal property or commonly owned |
| 11 | | property while in the immediate presence of that family or |
| 12 | | household member, as defined in subsection (3) of Section |
| 13 | | 112A-3 of the Code of Criminal Procedure of 1963, so as to |
| 14 | | deliberately and intentionally intimidate or threaten that |
| 15 | | family or household member. A peace officer must arrest the |
| 16 | | offender upon the establishment of probable cause. |
| 17 | | (b) Sentence. Domestic damage to property is a Class A |
| 18 | | misdemeanor.
