SYNOPSIS AS INTRODUCED:
 
50 ILCS 20/4a  from Ch. 85, par. 1034a

    Amends the Public Building Commission Act. Provides that a county board is not required to receive referendum approval to expand the purpose of a public building commission to include acquiring, enlarging, improving, repairing, replacing, or constructing a statutorily required government facility, including but not limited to, a courthouse.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Building Commission Act is amended by
5changing Section 4a as follows:
 
6    (50 ILCS 20/4a)  (from Ch. 85, par. 1034a)
7    Sec. 4a. A Public Building Commission may be created for
8the limited purpose of constructing, acquiring, enlarging,
9improving, repairing or replacing a specific public
10improvement, building or facility or a special type or class of
11public improvements, buildings or facilities. The provisions
12of Section 4 of this Act shall apply to the creation of a
13Public Building Commission under this Section, except that the
14resolution adopted by the municipality or county board and the
15proposition shall specify the limited purpose for which such
16Public Building Commission is to be created. The provisions of
17Section 4 authorizing any municipal corporation any part of
18whose area of jurisdiction lies within the territorial limits
19of that county seat to join in the organization of the Public
20Building Commission in the manner set forth in that Section
21shall not be applicable to a Public Building Commission created
22under this Section. The county board of any county that has
23created a public building commission for a limited and specific

1purpose may expand that purpose by resolution.
2    The purpose of a public building commission created by the
3county board of any county may not be expanded until the
4question of expanding the purpose of the public building
5commission has been submitted to the electors of the county at
6a regular election and approved by a majority of the electors
7voting on the question. The county board must certify the
8question to the proper election authority, which must submit
9the question at an election in accordance with the Election
10Code.
11    The election authority must submit the question in
12substantially the following form:
13        Shall the county board be authorized to expand the
14    purpose of the (insert name of public building commission)
15    to include (insert the purpose or purposes)?
16    The election authority must record the votes as "Yes" or
17"No".
18    If a majority of the electors voting on the question vote
19in the affirmative, the county board may thereafter expand the
20purpose of the public building commission.
21    Notwithstanding any provision of this Section to the
22contrary, a county board is not required to receive referendum
23approval to expand the purpose of a public building commission
24to include acquiring, enlarging, improving, repairing,
25replacing, or constructing a statutorily required government
26facility, including but not limited to, a courthouse.
