| 4 | | "Section 5. The Community Association Manager Licensing |
| 5 | | and Disciplinary Act is amended by changing Section 65 as |
| 6 | | follows:

| 8 | | (Section scheduled to be repealed on January 1, 2020) |
| 9 | | Sec. 65. Fees; Community Association Manager Licensing and |
| 10 | | Disciplinary Fund. |
| 11 | | (a) The fees for the administration and enforcement of this |
| 12 | | Act, including, but not limited to, initial licensure, renewal, |
| 13 | | and restoration, shall be set by rule of the Department. The |
| 14 | | fees shall be nonrefundable. |
| 15 | | (b) In addition to the application fee, applicants for the |
| 16 | | examination are required to pay, either to the Department or |

| 1 | | the designated testing service, a fee covering the cost of |
| 2 | | determining an applicant's eligibility and providing the |
| 3 | | examination. Failure to appear for the examination on the |
| 4 | | scheduled date, at the time and place specified, after the |
| 5 | | applicant's application and fee for examination have been |
| 6 | | received and acknowledged by the Department or the designated |
| 7 | | testing service, shall result in the forfeiture of the fee. |
| 8 | | (c) To support the costs of administering this Act, all |
| 9 | | community associations that have 10 or more units and are |
| 10 | | registered in this State as not-for-profit corporations shall |
| 11 | | pay to the Department a an annual fee of $50 plus an additional |
| 12 | | $1 per unit. The Department may establish forms and adopt |
| 13 | | promulgate any rules for the effective collection of such fees |
| 14 | | under this subsection (c). The fees under this subsection (c) |
| 15 | | shall no longer be required after December 31, 2014. |
| 16 | | Any not-for-profit corporation in this State that fails to |
| 17 | | pay in full to the Department all fees owed under this |
| 18 | | subsection (c) shall be subject to the penalties and procedures |
| 19 | | provided for under Section 92 of this Act. |
| 20 | | (d) All fees, fines, penalties, or other monies received or |
| 21 | | collected pursuant to this Act shall be deposited in the |
| 22 | | Community Association Manager Licensing and Disciplinary Fund.

| 24 | | Section 99. Effective date. This Act takes effect upon |
| 25 | | becoming law.".
