| 1 | | AN ACT concerning transportation.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing |
| 5 | | Section 11-1408 as follows:
|
| 6 | | (625 ILCS 5/11-1408) (from Ch. 95 1/2, par. 11-1408)
|
| 7 | | Sec. 11-1408. Riding in certain vehicles, riding in certain |
| 8 | | cargo areas of second division vehicles house trailers. |
| 9 | | (a) No person or persons shall occupy
a house trailer, |
| 10 | | semitrailer, farm wagon, or any other vehicle travel trailer |
| 11 | | while it is being towed upon a public highway, unless the |
| 12 | | occupancy of the towed vehicle is necessary to avoid an |
| 13 | | imminent threat to a person's safety due to extreme weather |
| 14 | | conditions or another emergency situation.

| 15 | | (b) No person or persons may occupy the cargo area of a |
| 16 | | second division vehicle while it is being operated upon a |
| 17 | | public highway, unless (i) the speed of the vehicle does not |
| 18 | | exceed 15 miles per hour and is used in connection with a |
| 19 | | parade, farming related activity, or similar activity; or (ii) |
| 20 | | the speed of the vehicle does not exceed 15 miles per hour and |
| 21 | | the passenger is over the age of 18. |
