AMENDMENT TO HOUSE BILL 1316




2    AMENDMENT NO. ______. Amend House Bill 1316 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Department of State Police Law of the
Civil 
5Administrative Code of Illinois is amended  by adding Section 
62605-407 as follows:
 
7    (20 ILCS 2605/2605-407 new)
8    Sec. 2605-407. Illinois State Police Projects Trust Fund. 
9The Illinois State Police Projects Trust Fund is created as a 
10trust fund in the State treasury. This Trust Fund is 
11established to receive funds awarded to the Department of State 
12Police from the following: (i) all federal departments and 
13agencies for the specific purposes established by the terms and 
14conditions of the federal awards and (ii) pass-through grants 
15from State departments and agencies for the specific purposes 
16established by the terms and conditions of the grant

1agreements. All interest earned by the investment or deposit of 
2moneys accumulated in the Trust Fund shall be deposited into 
3the Trust Fund.
 
4    Section 10. The Illinois Emergency Management Agency Act is 
5amended by adding Section 17.5 as follows:
 
6    (20 ILCS 3305/17.5 new)
7    Sec. 17.5. Homeland Security Emergency Preparedness Fund. 
8The Homeland Security Emergency Preparedness Fund is created as 
9a special fund in the State treasury. The Fund shall be held 
10separate and apart from all public moneys or funds of this 
11State. All moneys received by the Agency under Section 17 from 
12a federal department or agency shall be deposited into the 
13Fund. Interest earned by the investment or deposit of moneys 
14accumulated in the Fund shall be deposited into the Fund. The 
15Agency is authorized to expend any moneys in the Fund for the 
16specific purposes established by the terms and conditions of 
17the federal awards received by the Agency and in any amount 
18that the Agency deems necessary to make grants and pay expenses 
19in connection with its emergency management and preparedness 
20programs.
 
21    Section 15. The Illinois Motor Vehicle Theft Prevention Act 
22is amended  by adding Section 8.5 as follows:

1    (20 ILCS 4005/8.5 new)
2    Sec. 8.5. State Police Motor Vehicle Theft Prevention Trust 
3Fund. The State Police Motor Vehicle Theft Prevention Trust 
4Fund is created as a trust fund in the State treasury. The 
5State Treasurer shall be the custodian of the Trust Fund. The 
6Trust Fund is established to receive funds from the Illinois 
7Motor Vehicle Theft Prevention Council. All interest earned 
8from the investment or deposit of moneys accumulated in the 
9Trust Fund shall be deposited into the Trust Fund. Moneys in 
10the Trust Fund shall be used by the Department of State Police 
11for motor vehicle theft prevention purposes.


 
12    Section 20. The State Finance Act is amended by adding 
13Section 5.786 as follows:
 
14    (30 ILCS 105/5.786 new)
15    Sec. 5.786. The Homeland Security Emergency Preparedness 
16Fund.".
