| 1 | | If, after 2 years following its placement on academic watch |
| 2 | | status, a school remains on academic watch status, then the |
| 3 | | State Board of Education shall direct the school board to |
| 4 | | operate that school on a pilot full-year school plan approved |
| 5 | | by the State Board of Education upon expiration of its |
| 6 | | teachers' current collective bargaining agreement until the |
| 7 | | expiration of the next collective bargaining agreement. |
| 8 | | (b) In addition, if after 3 years following its placement |
| 9 | | on
academic
watch status a school district or school remains on
|
| 10 | | academic watch status, the
State Board of Education shall take |
| 11 | | one of the following actions for the
district or
school:
|
| 12 | | (1) The State Board of Education may authorize the |
| 13 | | State
Superintendent
of Education to direct the regional |
| 14 | | superintendent of schools to remove
school board members |
| 15 | | pursuant to Section 3-14.28 of this Code. Prior
to such |
| 16 | | direction the State Board of Education shall permit members |
| 17 | | of the
local board of education to present written and oral |
| 18 | | comments to the State
Board of Education. The State Board |
| 19 | | of Education may direct the State
Superintendent of |
| 20 | | Education to appoint an Independent Authority that shall
|
| 21 | | exercise such powers and duties as may be necessary to |
| 22 | | operate a school or
school district for purposes of |
| 23 | | improving pupil performance and school
improvement. The |
| 24 | | State Superintendent of Education shall designate one
|
| 25 | | member of the Independent Authority to serve as chairman. |
| 26 | | The Independent
Authority shall serve for a period of time |

| 1 | | specified by the State Board of
Education upon the |
| 2 | | recommendation of the State Superintendent of
Education.
|
| 3 | | (2) The State Board of Education may (A)
change the |
| 4 | | recognition status of the school district or school to
|
| 5 | | nonrecognized, or (B) authorize the State Superintendent
|
| 6 | | of Education to direct the reassignment of pupils
or direct |
| 7 | | the reassignment or replacement of school district |
| 8 | | personnel who
are relevant to the
failure
to
meet adequate |
| 9 | | yearly progress criteria. If
a school district is |
| 10 | | nonrecognized in its entirety, it shall automatically
be |
| 11 | | dissolved on July 1 following that nonrecognition and its |
| 12 | | territory
realigned with another school district or |
| 13 | | districts by the regional board
of school trustees in |
| 14 | | accordance with the procedures set forth in Section
7-11 of |
| 15 | | the School Code. The effective date of the nonrecognition |
| 16 | | of a school
shall be July 1 following the nonrecognition.

| 17 | | (c) All federal requirements apply to schools and school |
| 18 | | districts
utilizing
federal funds under Title I, Part A of the |
| 19 | | federal Elementary and Secondary
Education Act of 1965.

this subsection (a) Section shall devise a |
| 2 | | plan so that a student's required attendance
in school shall be |
| 3 | | for a minimum term of 180 days of actual attendance,
including |
| 4 | | not more than 4 institute days, during a 12 month period, but
|
| 5 | | shall not exceed 185 days. Under such plan, no teacher shall be |
| 6 | | required
to teach more than 185 days. A calendar of 180 days |
| 7 | | may be established
with the approval of the State Board of |
| 8 | | Education.

| 9 | | (b) Any school board that operates one or more schools |
| 10 | | within the school district on a pilot full-year school plan |
| 11 | | under subsection (a-5) of Section 2-3.25f of this Code shall |
| 12 | | devise a plan so that a student's required attendance in school |
| 13 | | shall be for a minimum term of 215 days of actual attendance, |
| 14 | | including not more than 4 institute days, during a 12-month |
| 15 | | period. A calendar of 215 days may be established with the |
| 16 | | approval of the State Board of Education. |
