Amends the Food Handling Regulation Enforcement Act. Provides that, notwithstanding any other provision of law, neither the Department of Public Health nor the health department of a unit of local government may regulate the serving or sale of food at a charitable fundraising event or at a farmers market.

| 1 | | AN ACT concerning public health.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Food Handling Regulation Enforcement Act is |
| 5 | | amended by adding Sections 3.3 and 3.4 as follows: |
| 6 | | (410 ILCS 625/3.3 new) |
| 7 | | Sec. 3.3. Charitable fundraising event. |
| 8 | | (a) As used in this Section, "charitable fundraising event" |
| 9 | | means an event that meets all of the following conditions: |
| 10 | | (1) the event is sponsored by a fraternal or religious |
| 11 | | organization; |
| 12 | | (2) food items are sold at the event; and |
| 13 | | (3)
the event is conducted for the purpose of raising |
| 14 | | funds for the sponsoring organization. |
| 15 | | (b) Notwithstanding any other provision of law, neither the |
| 16 | | Department of Public Health nor the health department of a unit |
| 17 | | of local government may regulate the serving or sale of food at |
| 18 | | a charitable fundraising event. |
