AMENDMENT TO HOUSE BILL 1530

AMENDMENT NO. ______. Amend House Bill 1530 as follows:

on page 11, line 8, by replacing "speech therapist, or other individual" with "speech-language pathologist, or other licensed or certified professional at a program"; and

on page 11, line 9, immediately after "Drug", by inserting "Abuse and"; and

on page 11, line 15, by replacing "speech therapist, or other individual" with "speech-language pathologist, or other licensed or certified professional at a program"; and

on page 11, line 16, immediately after "Drug", by inserting "Abuse and"; and

on page 11, lines 21 and 22, by replacing "speech therapist, or other individual" with "speech-language pathologist, or other licensed or certified professional at a program"; and

on page 11, line 23, immediately after "Drug", by inserting "Abuse and"; and

on page 12, line 2, by replacing "and licensed" with "and licensed"; and

on page 12, line 2, immediately after "therapists,", by inserting "licensed speech-language pathologists, and other licensed or certified professionals at programs licensed pursuant to the Illinois Alcoholism and Other Drug Abuse and Dependency Act,"; and

on page 12, line 5, by replacing "or" with "or"; and

"(2.5) "Substance use disorder" means the following mental disorders as defined in the most current edition of the Diagnostic and Statistical Manual (DSM) published by the American Psychiatric Association:

(A) substance abuse disorders;

(B) substance dependence disorders; and

(C) substance induced disorders.

(3) Unless otherwise prohibited by federal law and consistent with the parity requirements of Section"; and

on page 14, line 5, immediately after "illness", by inserting "or substance use disorder"; and

on page 14, line 25, by replacing "illness," with "illness or substance use disorder,"; and

on page 15, line 2, immediately after the period, by inserting "Medical necessity determinations for substance use disorders shall be made in accordance with appropriate patient placement criteria established by the American Society of Addiction Medicine."; and

on page 15, line 7, after "illness", by inserting "and substance use disorders"; and

on page 16, line 22, by replacing "Department" with "Department of Public Health or the Department"; and

on page 21, by replacing line 14 with the following:

"categories.

(d) This Section shall be interpreted in a manner consistent with the interim final regulations promulgated by the U.S. Department of Health and Human Services at 75 FR 5410, including the prohibition against applying a cumulative financial requirement or cumulative quantitative treatment limitation for mental, emotional, nervous, or substance use disorder benefits that accumulates separately from any cumulative financial requirement or cumulative quantitative treatment limitation established for hospital and medical benefits in the same classification.

(e) The provisions of subsections (b) and (c) of this Section shall not be interpreted to allow the use of lifetime or annual limits otherwise prohibited by State or federal law."; and

on page 21, line 15, by replacing "(d)" with "(f)".
